TO <br />FROM: <br />CITY OF COLTON <br />AGENDA REPORT <br />For Council Meeting of Sep mhPr 1, 1991 <br />Honorable Mayor and City Council <br />t-) <br />Leslie Keane Stratton, City Manager; <br />SUBJECT: <br />Award Contract for Street Improvements <br />On Meridian, Pepper, Randall And <br />San Bernardino Avenues to Fisher's Grading <br />BACKGROUND: <br />Date: 8/29/91 <br />During 1989 the City Council completed proceedings for the formation of <br />a Mello -Roos Community Facilities District (CFD 89-2) in a portion of the <br />West Valley. This action was validated by the San Bernardino Superior <br />Court in November 1989. This district was formed, in part, to finance <br />offsite, regional public improvements. <br />DISCUSSION• <br />At the time CFD 89-2 was formed, it was thought that water, sewer, and <br />street improvements would be performed by the developer, John Lang Homes, <br />who would then be reimbursed by the district. The developer was directed <br />to bid the required improvements in conformance with Municipal Public <br />Works contract law. An advertisement for street improvement bids was <br />published in the Colton Courier on February 28, 1991 and March 7, 1991. <br />Sealed bids were accepted until 4:00 p.m. on March 12, 1991 at the <br />offices of Paul A. Moote & Associates; six bids were received. A bid <br />summary is attached. <br />Since completion of the bidding process, special legal counsel to <br />CFD 89-2, Rutan & Tucker, has advised the City to assume responsibility <br />for award of the contract and project management for the street portions <br />of the required public improvements. The bid process followed by <br />John Lang Homes has been reviewed by the District engineers, NBS Lowry, <br />and has been found to be in conformance with the requirements of the <br />Public Contract Code. The low bidder, Fisher's Grading, has also been <br />recommended by NBS Lowry. <br />Water and sewer improvements will continue <br />developer. The City will verify that proper <br />procedures are followed prior to any <br />improvements. <br />Attachments: <br />to be performed by the <br />bidding and construction <br />reimbursement for these <br />Page t of_ 2_ — Item No.� <br />
