The suspension action was <br />based on the following incident and allegations: <br />1. On May 9, 1991, Gary G. Bouchez was observed, <br />while on duty and in a City Electric Department vehicle, <br />parked in a dirt field near the streets of Fairway and <br />Crossroads, north of the 10 freeway; and <br />2. On that occasion, a Colton police officer, <br />observing numerous empty beer containers on the ground near <br />Bouchez' City vehicle, approached to investigate. When <br />contacted by the officer, Bouchez had alcohol on his breath <br />and several unopened beer containers in a cooler located in <br />his vehicle (See City Exhibit Nos. 1 and 3). <br />This timely appeal followed. At the time the appeal hearing <br />was conducted, Mr. Bouchez had completed his period of <br />suspension. <br />At the hearing, opening statements by Counsel for the City <br />and Counsel for Bouchez were presented. The following documents <br />were introduced as Exhibits: <br />City Exhibit No. 1 - City of Colton letter, dated May 24, <br />1991, to Gary G. Bouchez, subject: Notice of Intent to <br />Suspend, with attachments (Colton Municipal Code Extract, <br />Section 9.20; Colton Police Department Report dated May 9, <br />1991, Case No. 91-59292; and, statement of Albert Quesada, <br />dated May 9, 1991); <br />City Exhibit No. 2 - City of Colton letter, dated June 10, <br />1991, to Gary G. Bouchez; and Sandra Night's interview with <br />(CIVIL SERVICE BOARD'S FINDINGS OF FACT) <br />(Page 2) <br />
