In our experience, many cities designate most code violations <br />as infractions, using misdemeanor classifications sparingly because of the efficiency to the <br />city of prosecuting infractions and obtaining fines. Where every violation is prosecuted as <br />a misdemeanor, the cost to the City of prosecution may well exceed the penalty ultimately <br />paid. <br />While the proposed ordinance will assist the City by giving the City Attorney <br />discretion regarding prosecution, the most effective solution would be for the City to identify <br />those violations where an infraction prosecution is always the preferred first step in Code <br />Enforcement. <br />JULIE HAYWARD BIGGS <br />Attachment: Ordinance <br />JH894672 _2 <br />
