Califoraia - Local Rent <br />Control Ordinances: Physical or Regulatory Taking? <br />The following is a proposed memorandum which may be <br />circulated to our municipal clients who have local rent control <br />ordinances for mobilehome parks. <br />1. Overview of State Law Affecting Mobilehome Parks <br />The California Mobilehome Residency Lawl ("Ng2L" ), enacted <br />in 1978, limits mobile' home park owners' ability to terminate <br />rights of those who rent space for mobile homes. The Na2L is the <br />primary statutory scheme affecting mobilehome tenancies. It <br />governs the relationship between homeowners and mobilehome park <br />management (owners and their agents), the rental agreement, park <br />rules and regulations, fees and charges, park homeowner meetings, <br />termination of mobilehome tenancies, transfer of mobilehomes or <br />mobilehome parks, as well as sales in subdivisions, cooperatives <br />and condominiums for mobilehomes. <br />1 Civ.
