CITY OF COLTON <br />AGENDA REPORT <br />For Council Meeting of February 4, 1992 <br />TO: Honorable Mayor and City Council <br />FROM: John C. Hutton, Director of Public Works <br />NPDES Implementation Agreement for the Regulation <br />of Date: January 27, 1992 <br />l <br />SUBJECT: 9 � <br />Stormwater in that Portion of San Bernardino County <br />within the Santa Ana River Watershed <br />FUdV.4 7 - k1l.91A <br />This report is being submitted for informational purposes. <br />The Federal Clean Water Act was amended in 1987 to control pollutants from stormwater <br />discharges by requiring a National Pollutant Discharge Elimination System (NPDES) Permit <br />for the discharge of storYnn+ater into receiving streams or bodies of water. Such a <br />permit was issued in 1990 by the Santa Ana Regional Water Quality Control Board (RWQCB) <br />to San Bernardino County, San Bernardino County Flood Control District and 16 Cities <br />within the Santa Ana River watershed in San Bernardino County as co -permittees. RWQCB <br />selected the County Flood District as the principal permittee. Working with the staff <br />of the 16 Cities and the County, the Flood Control District has recently developed <br />the attached Draft Implementation Agreement required by the NPDES permit and submitted <br />for review by all co -permittees. <br />n T SC'1155 I ON : <br />The permit from the RWOCS required the implementation agreement to be ratified by all <br />co -permittees and returned to RWQCB by April 30, 1991. However, factors at all levels <br />of government made this date unrealistic. Currently the agreement lacks reliable <br />FY92-93 cost information, particularly on monitoring. This information cannot be <br />generated until the City furnished stormwater system maps and SCAB land use data are <br />correlated on a GIS map by San Bernardino County. <br />When the cost informtion is provided, the RWOM has given the co -permittees a period <br />of 90 days to approve and sign the agreement. <br />FINANCIAL I NVACT : <br />The monitoring, administrative and permit costs will be shared on the basis of a <br />formula to provide fairness as outlined in the draft implementation agreement. Costs <br />for FY92-93 will be included in "final" agreement when submitted for Council action. <br />No local funding sources are identified at this time. <br />RECCNfvF-NDAT I ON: <br />Staff recommends the Council review the draft NPDES implementation agreement, ask staff <br />for clarification on any unclear details and be prepared to act within 90 days after <br />the missing cost information has been pr ided <br />GW/1j 3 <br />CITY M~GER'S CONCURRENC <br />Attr^hment: <br />Page, No. 1 <br />
