Hutton, Director of Public Works NPDES Implementation Agreement for the Regulation of Date: January 27, 1992 l SUBJECT: 9 � Stormwater in that Portion of San Bernardino County within the Santa Ana River Watershed FUdV.4 7 - k1l.91A This report is being submitted for informational purposes. The Federal Clean Water Act was amended in 1987 to control pollutants from stormwater discharges by requiring a National Pollutant Discharge Elimination System (NPDES) Permit for the discharge of storYnn+ater into receiving streams or bodies of water. Such a permit was issued in 1990 by the Santa Ana Regional Water Quality Control Board (RWQCB) to San Bernardino County, San Bernardino County Flood Control District and 16 Cities within the Santa Ana River watershed in San Bernardino County as co -permittees. RWQCB selected the County Flood District as the principal permittee. Working with the staff of the 16 Cities and the County, the Flood Control District has recently developed the attached Draft Implementation Agreement required by the NPDES permit and submitted for review by all co -permittees. n T SC'1155 I ON : The permit from the RWOCS required the implementation agreement to be ratified by all co -permittees and returned to RWQCB by April 30, 1991. However, factors at all levels of government made this date unrealistic. Currently the agreement lacks reliable FY92-93 cost information, particularly on monitoring. This information cannot be generated until the City furnished stormwater system maps and SCAB land use data are correlated on a GIS map by San Bernardino County. When the cost informtion is provided, the RWOM has given the co -permittees a period of 90 days to approve and sign the agreement. FINANCIAL I NVACT : The monitoring, administrative and permit costs will be shared on the basis of a formula to provide fairness as outlined in the draft implementation agreement. Costs for FY92-93 will be included in "final" agreement when submitted for Council action. No local funding sources are identified at this time.
