oFcq,
CITY OF COLTON`MCOIIPDq
004
4TEO
1887
lIFOft
INTEROFFICE MEMORANDUM
TO: RICHARD ACEVEDO, Finance Director DATE: March 3, 1993
FILE NUMBER:
FROM: Mary J. Scribner, Buyers Ivl
SUBJECT: Warranty on 15 Gallon Parkway Trees
I spoke with Ron Brav of Ron Brav's Nursery this morning at 8:30 a.m.,
regarding his warranty on the trees he sells. He indicated that his
nursery does not have a specific time frame on their warranty.
Their warranty is a guarantee to sell a live, healthy, disease free
tree. They stand behind their trees and if a tree dies due to some
fault of theirs, they will replace it.
I spoke to the Park Supervisor on this matter and he said that all of
the trees we purchase are inspected before they are planted to make
sure they are disease free and healthy. They do not accept any trees
they do not approve of. Once the tree is planted in the parkway, it
becomes the homeowners responsibility to water and care for the tree.
The Park Division does not try to return a tree to the nursery once
it has been planted.
I contacted Frank Pendleton of Green Earth Nursery, the supplier we
have used in the past, to get the details of their warranty. I was
told that they have no warranty on trees, as they have no control over
how the trees will be taken care of once they have been planted. I
specifically asked if the City purchased a tree from them and it died
after it was planted, would they replace it. The answer was no.
The bid specification did not include any warranty requirements other
than providing a healthy tree based upon the City's inspection.
