Scribner, Buyers �Ivl <br />SUBJECT: Warranty on 15 Gallon Parkway Trees <br />I spoke with Ron Brav of Ron Brav's Nursery this morning at 8:30 a.m., <br />regarding his warranty on the trees he sells. He indicated that his <br />nursery does not have a specific time frame on their warranty. <br />Their warranty is a guarantee to sell a live, healthy, disease free <br />tree. They stand behind their trees and if a tree dies due to some <br />fault of theirs, they will replace it. <br />I spoke to the Park Supervisor on this matter and he said that all of <br />the trees we purchase are inspected before they are planted to make <br />sure they are disease free and healthy. They do not accept any trees <br />they do not approve of. Once the tree is planted in the parkway, it <br />becomes the homeowners responsibility to water and care for the tree. <br />The Park Division does not try to return a tree to the nursery once <br />it has been planted. <br />I contacted Frank Pendleton of Green Earth Nursery, the supplier we <br />have used in the past, to get the details of their warranty. I was <br />told that they have no warranty on trees, as they have no control over <br />how the trees will be taken care of once they have been planted. I <br />specifically asked if the City purchased a tree from them and it died <br />after it was planted, would they replace it. The answer was no. <br />The bid specification did not include any warranty requirements other <br />than providing a healthy tree based upon the City's inspection. <br />
