LAMUKIA <br />Community Develop t Di <br />SUBJECT: Consider an amendment to Section 18.58.020 of the Colton Municipal DATE: March 23, 1994 <br />Code relating to "Certificates of Occupancy" <br />(File Index Number DO -05-94) <br />BACKGROUND: <br />At their March 8, 1994 Planning Commission meeting, the Commission considered and <br />approved an amendment to the Zoning Ordinance by replacing the term "Certificate of <br />Occupancy" with "Business Occupancy Permit". <br />The proposed amendment was requested by an ad hoc Committee consisting of representatives <br />from the following Departments: Finance, Fire, Electric, Public Works, Community Development <br />and the Chamber of Commerce. <br />The objective of the Committee was to review the Certificate of Occupancy process and <br />recommend modifications that, in their opinion, would improve the process. Upon completion <br />of their review, the Committee recommended the above proposed amendment, due to confusion <br />that sometimes occurs due to the lack of distinction between the Certificate of Occupancy as <br />used in the Building Codes and the Certificate of Occupancy process referred to in the Zoning <br />Ordinance (which pertains to land use). <br />DISCUSSION/ANALYSIS: <br />The term "Business Occupancy Permit" was selected by the committee because it more clearly <br />describes the objective of the process being considered. When an applicant (business) is <br />locating, or relocating from one place to another, in the City the process would be handled <br />through the "Business Occupancy Permit" process. Providing the building has an existing <br />Certificate of Occupancy. <br />ENVIRONMENTAL CONCERNS <br />Staff has determined that the proposed amendment is categorically exempt, per Section 15321 <br />(a) (1) of the California Environmental Quality Act guidelines and recommends a Notice of <br />Exemption be prepared. <br />Page 9 Item No. Oz I <br />
