Young, City Manager <br />Subject: Public Hearing to Consider an Amendment to Chapter 6.22, Sections 6.22.010 <br />through 6.22.040 of the Colton Municipal Code Regarding Weed Abatement <br />BACKGROUND: <br />On January 18, 1994, the City Council approved the request for staff to develop an in-house weed <br />abatement program to be administered by the City of Colton Fire Department. On February 15, 1994, the <br />City Council approved Resolution No. R-19-94, which gives the Fire Chief the authority to give notice to <br />property owners which own property where weeds or rubbish constitutes a public nuisance and which <br />must be abated. Additionally, the Resolution authorizes the Fire Chief to approve a contractor to perform <br />the abatement, to charge an administrative fee and to place all contractor's fees plus the administrative fee <br />on the San Bernardino County Tax Roles for collection. <br />DISCUSSION: <br />The proposed amendment will amend Chapter 6.22, (all sections 6.22.010 - 6.22.040) of the Colton <br />Municipal Code, which provided standards and procedures for the abatement of weeds and refuse by the <br />county within the corporate limits of the City of Colton. The proposed amendment will be complemented <br />by allowing the City Council to set by Resolution as to who will provide standards and procedures for the <br />abatement of weeds and refiise in the City of Colton in the fiiture. <br />FISCAL IMPACT: <br />Initially, incidental expenses will arise such as postage, mailing and equipment costs that will be covered <br />by estimated revenues. All contractor's costs plus the administrative fee will be recouped through the San <br />Bernardino County Property Tax Roles. During the last calendar year the county abated 462 parcels in <br />Colton. Four -hundred sixty two parcels abated at $75 per parcel would generate $34,650 in revenue. <br />RECOMMENDATION: <br />Staff recommends approval of the attached Ordinance amending Section Chapter 6.22 of the Colton <br />Municipal Code. <br />Attachment (1) <br />c:\wlnword\040594.a Qr\03/29/94\d jp <br />
