AGENDA REPORT <br />CITY OF COLTON <br />For City Council Meeting of <br />April 5, 1994 <br />March 24, 1994 <br />TO: HONORABLE MAYOR AND CITY COUNCIL <br />FROM: Julie Hayward Biggs, City Att me <br />SUBJECT: Effect of Shift to 5/8 Work Schedule/Police Department <br />At the City Council meeting on March 15, 1994, the City Attorney was requested <br />to review factors affecting the Police Department Rank & File Unit as well as the Police <br />Department Management Unit with regard to any change that the City Council might choose to <br />make in the current 4/ 10 work schedule to determine whether this is a meet and confer matter. <br />It is the legal opinion of the City Attorney that any such change in work schedule will require <br />renegotiation of the MOD's affecting both the Police Department Rank & File and the Police <br />Department Management Units. <br />The current MOD's for these groups were each adopted on August 5, 1992. The <br />Police Department Rank & File MOU reads as follows: <br />"The Police Rank & File Unit shall be placed on the 4/10 or 3/12 work schedule, <br />whichever is appropriate, within 90 days of the adoption of this MOU. The <br />parties will meet to determine what schedule is appropriate and the details of <br />implementation. " <br />The current MOU remains in effect until December 1994. The Police Rank & File Unit was <br />placed on the 4/10 or 3/12 work schedule within the time frame required by the MOU. <br />Working conditions, including the work schedule are clearly a part of the negotiated agreement <br />between the City and the Police Department Rank & File Unit. In order to change working <br />conditions including the work schedule for this bargaining unit, the MOU must be amended and <br />that can only be done through the bargaining process. <br />Similarly, the MOU for the Police Department Management Unit provides as <br />follows: <br />"The Police Management Unit shall be placed on the 4/10 or 3/12 work schedule, <br />whichever is appropriate, if the Police Rank and File Unit is placed on an <br />alternate work schedule. The parties shall meet to work out any necessary <br />details. " <br />jj�w V.3z <br />
