AGENDA REPORT
City Council Meeting
March 31, 1994
not intended for or in use as a public forum is a substantial governmental purpose and such
restrictions are valid so long as they are content -neutral and do not unreasonably limit alternative
avenues of communication.
Thus, the City has the authority to impose restrictions on the placement of printed
materials for distribution within city buildings so long as those restrictions relate to the time,
manner and place of such distribution and not to the content of the printed materials. In view
of the readily available public space for distribution of printed materials outside city buildings,
limiting placement of such materials to those outdoor locations would appear to meet the relevant
constitutional requirements.
The Resolution does permit placement of official City sponsored or endorsed
printed materials within City Hall, consistent with the use of city buildings by the City for
administrative and public information purposes.
Concurrence:
City Manager
