RESPONSIBILITY OF THE PERSONNEL DEPARTMENT <br />The Personnel Department is responsible for administering the complaint <br />procedure, conducting an investigation, consulting with the Department <br />Head, and forwarding the results of the investigation to the Personnel <br />Officer ( City Manager) . <br />VIII.COMPLAINT PROCEDURE <br />1. Any employee who feels he/she has been the victim of harassment <br />should contact their department head or a staff member in the <br />Personnel Department within fourteen (14) calendar days of the <br />incident. This initial report can be oral or written, but a <br />written and signed statement of the complaint must be submitted to <br />the Personnel Department by the complaining employee within five <br />(5) working days of the initial report so an investigation can <br />proceed into the matter. <br />2. Upon receipt of the written complaint, the Personnel Department <br />shall investigate the charges including contact the person who <br />allegedly engaged in the harassment, informing them of the basis of <br />the complaint and providing an opportunity to respond in writing. <br />3. Upon completion of the investigation, the Personnel Department <br />shall forward investigative results to the Personnel Officer who <br />shall determine what, if any, disciplinary action will be taken. <br />Both parties shall be notified of the action to be taken. <br />4. If it is determined that harassment occurred, appropriate <br />disciplinary action up to and including dismissal will be taken. <br />The severity of the discipline will be determined by the severity <br />and/or frequency of the offense(s). <br />5. Disciplinary action taken under this procedure may be appealed with <br />or without representation pursuant to appeal or grievance <br />procedures indicated in applicable agreements (MOU's) or Civil <br />Service Rules. <br />6. The City shall take appropriate corrective/disciplinary measures <br />against an individual who files an intentional false complaint. <br />By establishing this Policy the City of Colton desires to guarantee to every <br />employee a non -hostile work environment free of any form of harassment. <br />B10:HARAss <br />
