Box 3000 <br />31315 Chaney Street <br />Lake Elsinore, CA 92531-3000 <br />Elsinore Valle Municipal strict (909) 674-3146 <br />Valley ll WtDistrict Fax: (909) 674-9872 <br />1994 <br />The Cities of Anaheim, Azusa <br />Banning, Colton and Riverside, <br />California <br />Re: Letter Agreement Among the Elsinore Valley Municipal <br />Water District and the Cities of Anaheim, Azusa, <br />Banning, Colton and Riverside, California <br />Gentlemen: <br />The Elsinore Valley Municipal Water District ("EVMWD") and the Cities of <br />Anaheim, Azusa, Banning, Colton and Riverside (the "Cities") (collectively "Parties" <br />and individually "Party") have had a dispute regarding the development of the Lake <br />Elsinore Pumped Storage Project ("Project,'). The Cities currently hold a preliminary <br />permit for the Project issued by the Federal Energy Regulatory Commission ("FERC") <br />on May 17, 1993 docketed as Project No. 11261. EVMWD filed a competing preliminary <br />permit application which was denied by the FERC. The Parties now desire to enter into <br />this binding Letter Agreement which will resolve their dispute and settle between <br />them which party will take the initiative as to the development of the Project and <br />establish the obligations and rights of the Parties with regard to the development of the <br />Project by EVMWD. <br />Section I -- Term of Agreement <br />This Letter Agreement shall become effective on the date that it is executed by a <br />duly appointed representative of each of the Parties and shall expire in accordance with <br />Section VI, unless extended in writing upon the mutual consent of all of the Parties. <br />
