CITY OF COLTON <br />AGENDA REPORT <br />for Council Meeting of December 20. 1994 <br />TO: HONORABLE MAYOR AND CITY COUNCIL DATE: December 15, 1994 <br />FROM: JOHN C. HUTTON, <br />Public Works Director <br />SUBJECT: SET FOR PUBLIC HEARING ON JANUARY 17, 1995 THE PROPOSED ABANDONMENT <br />OF CERTAIN PORTIONS OF PUBLIC RIGHT OF WAY <br />BACK GROUND: <br />The City of Colton, by means of a settlement agreement with the Adams Advertisement Company, agreed to <br />allow the installation of 10 Billboard signs in various locations as shown on the attached Exhibit Maps and Legal <br />Descriptions. <br />Athough being located within various right-of-ways, the Bill Board sign poles do not infringe onto any portion of <br />the traveled roadway or pedestrian parkway/pathway areas. <br />All poles for the proposed signs are located behind the walkway, or within areas of right-of-ways not accessible <br />to either vehicles or pedestrians. <br />FINANCIAL EMPACT: <br />The City of Colton, through its previously approved settlement agreement, would receive in Franchise Fees to the <br />General Fund, $160,000.00 dollars per year for the 10 signs, plus be provided two sign faces for either City <br />related public advertising or rental income. Said income from the two sign faces would equal the market rental <br />rate of $2000.00 to $ 3000.00 dollars per sign face, per month, or an annual (approximate) income of <br />$60,000.000 dollars. <br />Under Chapter 4 Section 1920 et al Streets and Highways Code, the local jurisdiction has the ability to abandon <br />and remove from public use streets or portions there of (copy attached). <br />RECOMMENDATION: <br />If Council concurs, it would be appropriate to set January 17th 1995, as the date to hear any protest to the <br />proposed abandonment of various locations of Street Right -of -Ways as requested. <br />Additionally, Staff would recommend Councils' authorization to present a proposed Ordinance and Resolution, <br />establishing Business License and Franchise Fee requirements for 28 existing Billboard signs already located <br />within the City of Colton. <br />The Business License Division of Community Development in conjunction with the City's Public Works <br />Department and City Attorney's office, can repo:to the City Council as to the City s authority and ability <br />in doing so. <br />CITY MANAGERS CONCURRENCE: <br />Item ��'" <br />
