Lavin, Water Utilities Coordinator <br />SUBJECT: Date <br />Approval of the City of Colton's Participation <br />in the Rialto Basin Association <br />BACKGROUND: <br />The City of Colton has extraction water rights, along with the Cities of Rialto and <br />San Bernardino and West San Bernardino County Water District (Rialto Basin <br />Association), for the Rialto/Colton Water Basin. The City of Colton has 5 wells <br />located in this Basin and extracts 5048.440 acre feet of water per year from the <br />Basin. <br />DISCUSSION: <br />Crawford Canyon Mutual Water Company plans on extracting and exporting 10,000 <br />acre feet of water from the Basin. Attorneys for the Rialto Basin Association have <br />determined that Crawford Canyon does not have any rights to the water and have <br />filed a cease and desist order. <br />The City of Colton has a 25.51 % interest in the water rights to the Basin, and has <br />been requested by the Rialto Basin Association to participate in paying the legal, <br />engineering and research fees at 25.51 %. <br />FINANCIAL IMPACT: <br />The cost for the City of Colton's participation at this time is $9,500 for fees <br />incurred to date. If a lawsuit becomes necessary, then the cost will increase. <br />Sufficient funds are available in the Water Professional Services Account #21- <br />6001-35. <br />RECOMMENDATION: <br />Staff recommends that Council approve the City of Colton's participation in the <br />Rialto Basin Association and authorize the expenditure of funds for the payment of <br />legal, engineering and research fees. <br />LJ/lj <br />Attachments: <br />CITY MANAGER'S CONCURRENC <br />Page 1 of___ — Item No.- <br />o. <br />
