AGENDA REPORT CITY OF COLTON For City Council Meeting of March 10, 1994 March 10, 1994 TO: HONORABLE MAYOR AND CITY COUNCIL FROM: Julie Hayward Biggs, City Attorney SUBJECT: Moratorium on Issuance of Hillside Building Permits/Reche Canyon and Environs As requested by the City Council, I have prepared the attached interim urgency ordinance. Pursuant to the provisions of Government Code Section 65858, this Ordinance will take effect immediately upon its adoption by the Council and remain in effect for a period of 45 days unless extended by further action of the City Council. During the initial 45 day period, it will be incumbent upon the Public Works Department and the Community Development Department to review all current construction standards as they relate to compaction issues in order to determine whether changes are needed in order to prevent future problems such as those now being experienced by homeowners in the Reche Canyon area. Depending on the outcome of the studies conducted by Public Works and Community Development, City Code revisions may be recommended. As I understand it, at the present time, City Code provisions relating to compacting are in accord with uniform standards and fully protect the City from any liability for damages that may result from construction in hillside areas. The purpose of the moratorium is simply to verify that fact and determine whether any greater steps might be taken by the City to assure proper construction in such areas. This measure does not require a public hearing and it will become effective with only this initial reading. It does require, however, a four-fifths vote of the City Council. Concurrence: City Manager
