CITY OF COLTON <br />AGENDA REPORT (coNT�NUE�1 <br />FOR COUNCIL MEETING OF MAY 3, 1994 <br />SUBJECT: An Appeal of Planning Commission's decision concerning File Index <br />Number DCV-54-93 relating to Thermal Combustion Innovators, Inc. <br />VARIANCE STANDARDS <br />A Major Variance, according to section 18.58.040 of the Colton Municipal Code (Zoning <br />Ordinance) shall be granted only when, because of special circumstances applicable to the <br />property, including size, shape topography, location, or surroundings, the strict application <br />deprives such property of privileges enjoyed by the property in the vicinity and under identical <br />zoning classification. <br />As previously stated, the applicant is requesting a Major Variance due to the height of the main <br />discharge stack anticipated to project 10 feet above the maximum building height of 40 feet. <br />The proposed new incinerator is designed and engineered with a 50 foot high main discharge <br />stack and, according to the applicant's representatives, cannot be lowered to comply with the <br />maximum building height. Again, as stated above, staff is of the opinion that the request for <br />a major variance is not consistent with the guidelines of the Zoning Ordinance. <br />COMPATIBILITY TO SURROUNDING USES <br />The proposed project is located within an existing Industrial area with residential neighborhoods <br />located within a close proximity to the west, east, and south. Staff has received approximately <br />337 signatures, and several phone calls, in opposition to the proposed project. Most of the <br />callers cite health reasons for their opposition. Although the proposed project is located in an <br />M-1 zone, just west of the site are single family residences in a designated R-1 zone. <br />Staff has received calls regarding excessive odors and ash-like dust particles from adjoining <br />properties. Staff has also been informed of, and provided with over 2,500 signatures collected <br />on behalf of the applicant in favor of keeping the jobs generated by Thermal Combustion <br />Innovators in the City. <br />ENVIRONMENTAL CONCERNS <br />Staff processed the application through Environmental Review and recommended that a <br />Negative Declaration be prepared for this project. <br />FINANCIAL IMPACT: <br />Unknown <br />Page 4 of 5 Item No. <br />
