STAFF REPORT <br />The California Integrated Waste Mansâșlement Act of 1989 (AB 939), as amendW, nquires all <br />Cities and Counties to prepare and implement Source Reduction and Recycling Elements (ERRE) <br />and Household Hazardous Waste dements HWE) of an Integrated Waste Managetment Pian <br />rrhe ne sswry studies and analysis required to prepare the individual local agency plans for <br />compliance with Assembly Bill 939 are best performed on a regional basis. <br />In August of 1990, the Cines of COLTON, FONTANA, GRAND TERRACE, HIGHLAND, <br />LOMA LINDA, REDLANDS, RIALTOO SAN BERNARDINO, YUCAIPA, and the CIJNTY <br />CE SAN BERNARDINO enured into a Memorandum of Understanding OU) as "The East <br />Valley Cotton" for a period of two years to fund and obtain consulting services to study waste <br />composition and :management practices within the Past Valley and develop SRRE and RIFE <br />for each jurisdiction pursuant to Public Resources Code Section 40000 et. seq. ne 1l OU <br />further autho*ized the County of San Bernardino Department of Solid Waste Managerne;lt tO <br />include a landfill. tee surchuge of $1.00 por ton to accomplish these mandates of AE 939, <br />On June S, 1992, the Board of Supervisors of San Bernardino County, California reserved the <br />balance of the East Walley Coalition AB 939 Waste Characterization 'crust, Fund and designated <br />it fbr future AB 939 related studies and/or programs. <br />on January 11, 1993, rougMy 15 months ago, the San Bernardino County Board of Supervisors <br />mithorized it ,Material Recovery Facility/Transfer Station/Composting Pa ity study by SCS <br />Enginews for $85,968 to detemine solid waste processing facility needs and report on siting <br />Possibilities for necessaxy projects, The City of San Bernardino has performed site feasibility <br />comparisons and site assessments in conjuncOon with this study to prepare for a regional facility. <br />The current unabligated balance for the East Valley Cogition AB 939 Waste, 0aracrerization <br />Trust Fuad is approximately $8940032. EVC memo= anticipated using the surplus for <br />mnsultant studies to draft Non Disposal Facility Elements (NDFEs) and to revise the SRRE per <br />new legislation. However, NDPEs were completed in-house by all EVC staff and the State has <br />indicated a simple letter of addendum wil I suffice for SRRB mesion. ` hiis leaves no fortis able <br />joint use of the surplus Mending. <br />The original intent of the AB 939 landfill surcharge was to fund SRREs and HHWEs and related <br />project$, Casts were not knorm at the time die $1,00 ger ton surcharge was established.
