Lavin, Water Utilities Manager <br />SUBJECT: Date <br />Approval to Participate in the Rialto Basin <br />Management Board Regarding Water Issues <br />BACKGROUND: <br />On March 15, 1994 Council approved the City's participation in the Rialto Basin <br />Association (now Management Board). The City's share of attorney fees for the <br />Crawford Canyon lawsuit was $9,500. The lawsuit was settled, and the water <br />purveyors in the Rialto Water Basin were successful in retaining our pumping rights. <br />DISCUSSION: <br />At this time, there are other projects being proposed which will affect the Rialto <br />Water Basin. Therefore, the water purveyors participating in the Rialto Basin <br />Management Board are requesting that the Board continue. The City of Colton has <br />5 wells located in this Basin and extracts 5048.440 acre feet of water per year <br />from the Basin. <br />FINANCIAL IMPACT: <br />The City of Colton has a 25.51 % interest in the water rights to the Rialto Water <br />Basin. The City's share of legal fees will be at 25.51 % of the total cost. The <br />estimated amount for the City's share is $10,000. Sufficient funds are budgeted <br />each fiscal year for legal fees in the Water Professional Services Account #21- <br />6001-35. <br />RECOMMENDATION: <br />Staff recommends that Council approve the City of Colton's participation in the <br />Rialto Basin Management Board in order to protect the City's water rights, and <br />authorize the expenditure of funds in the amount of $10,000 for the payment of <br />legal fees. <br />LJ/I j <br />CITY MANAGER'S CONCURRENCE: <br />zl� <br />Attachments: <br />Page 1 of_—_ _ Item No. <br />
