CITY OF COLTON <br />AGENDA REPORT <br />For Council Meeting of October 401994 <br />TO: Honorable Mayor and City Council <br />FROM: Robert A. Lavin, Water Utilities Manager <br />SUBJECT: Date: <br />Acceptance of Assignment Agreement with <br />Southern Pacific Transportation Company for <br />a e Pipeline <br />BACKGROUND: <br />In 1991 John Laing Homes constructed at 16" water line under the Southern Pacific <br />railroad tracks as a part of their development. The lease agreement was placed in <br />the name of John Laing Homes, however, the City of Colton, Water, has made the <br />lease payments of $1 10/yr. since 1992. <br />DISCUSSION: <br />Since 1992, John Laing Homes and the City of Colton have attempted to have the <br />lease changed to the City of Colton as lessee. Southern Pacific has agreed to <br />assign the lease to the City of Colton at a fee of $250. <br />FINANCIAL IMPACT: <br />John Laing Homes has agreed to pay the fee of $250. <br />RECOMMENDATION: <br />Staff recommends that Council accept the Assignment Agreement with Southern <br />Pacific Transportation Company for 16" Water Pipeline. <br />LJ/fj <br />CITY MANAGER'S CONCURRENCE - <br />Attachments: <br />Page 1 of-.---- Item No. <br />
