AGENDA REPORT <br />CITY OF COLTON <br />Qffice qf the City Attorney <br />For City Council Meeting of <br />September 6, 1994 <br />August 29, 1994 <br />TO: HONORABLE MAYOR AND CITY COUNCIL <br />FROM: Julie Hayward Biggs, City Attor4l <br />SUBJECT: Mr. and Mrs. Anderson/Reche Canyon Soils Issues <br />As you may recall, Mr. Stephen Anderson has appeared before the City Council <br />on several occasions requesting support from the City in his dispute with the developer of his <br />home in Reche Canyon. Mr. Anderson has indicated that he does not intend to sue the City over <br />damages he has suffered as a result of significant settling of the uncompacted fill underlying his <br />house. Although Mr. Anderson indicated that his attorney would be in touch with this office, <br />no one has contacted me on his behalf. I have, however, been in contact with a representative <br />of the developer, Bel Air Financial Corporation ("Bel Air") in an effort to determine what legal <br />assistance the City may provide to Mr. and Mrs. Anderson. <br />Attached is a copy of a letter which I sent to Bel Air. Also attached are copies <br />of correspondence between the attorney for the Andersons and Bel Air. As you can see, the <br />Andersons have been in touch with Bel Air in an attempt to resolve their problems with their <br />home in Reche Canyon. It appears from these letters that Bel Air has agreed to repair the <br />structural damage to their home that has been suffered by the Andersons. <br />The City's interest in this matter is to assure that the structure is sound so that it <br />poses no risk if harm to persons or property. As both experts for Bel Air and for the <br />Andersons' insurance company concur in what needs to be done to repair the property so that <br />it poses no such risk, and as Bel Air is willing to make the repairs at no cost to the Andersons, <br />the City's interest has been or will be fully addressed. <br />The Andersons are seeking additional damages specific to them for their <br />difficulties in obtaining satisfactory resolution of this matter. Because the City has no knowledge <br />or involvement in those matters that the Andersons have alleged, and no interest in any recovery <br />that may be forthcoming, those matters are are personal to the Andersons and must pursued by <br />them on their own. <br />,OX Vr AVZ f 4j) <br />
