City Council - November 4, 1997 <br />Appeal of File Index Number D-24-97 <br />Page 2 <br />It is also staff's opinion that the project does not conflict with the guidelines of the Zoning <br />Ordinance. The applicant will be required to comply with the Conditions of Approval instituted <br />by the Design Review Committee, as there will be changes to the existing condition of the <br />land, and conditions are established to mitigate neighborhood, access and aesthetic <br />concerns. <br />The proposed project is located in an area where several tracks are installed and in use. The <br />proposal is for the railroad to join two of those existing tracks. The surrounding land uses <br />include single family and multi -family zoned properties, as well as commercial and industrial <br />zoned parcels. Railroad tracks are existing adjacent to all the various zones within the City, <br />and are accepted as infrastructure as much as are streets, highways, and freeways, as a <br />means of transport and conveyance of goods. It is staff's opinion that the proposed project is <br />compatible with the surrounding uses. <br />The findings for this project are as follow: <br />1. The proposal is considered to be consistent with the intent and guidelines of the <br />General Plan. <br />2. The proposed project is consistent with the Zoning Ordinance, provided the <br />applicant complies with the Conditions of Approval, which meet the developrr" '` <br />standards for this type of project. <br />3. The proposal is considered to be compatible with its surrounding uses. <br />4. The proposal will not have a significant effect on the environment and warrants a <br />Negative Declaration. <br />FINANCIAL IMPACT: <br />None. <br />RECOMMENDATION: <br />Based on the above analysis, staff recommends approval of the project and Negative <br />Declaration, for File Index Number D-24-97, subject to the Conditions of Approval, and <br />adoption of the attached resolution. <br />Should City Council approve the filing of Negative Declaration for this project, the City of <br />Colton Public Works Department, Engineering Division, shall proceed with completing the <br />necessary documents and reports to be submitted to Council for final review and approval of <br />the Street Vacation request. <br />Report prepared by Lisa R.
