Landscape Agreement - State of California <br />73 <br />Mr. Williams said the second agreement is with the State Department of Transportation and <br />provides for the State to furnish, install and construct landscaping, pay cost of plans, <br />specifications and inspections and to maintain the area within freeway right of way. Mr. <br />Williams said the City of Colton shall provide adequate water during installation of land- <br />scaping and thereafter for maintenance. <br />On motion of Councilwoman Spragins, seconded by Councilman Hayes and unanimously passed, <br />Resolution No. 3454 was approved. <br />RESOLUTION NO. 3454 - RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COLTON APPROVING AGREEMENT <br />FOR PARTICIPATION IN LANDSCAPING ON STATE HIGHWAY 08 -SBD -10, 15E, IN AND <br />NEAR COLTON ON ROUTE 10 FROM WARM CREEK BRIDGE TO SOUTH "E" STREET AND <br />ON ROUTE 15E FROM STEEL ROAD TO FAIRVIEW DRIVE. <br />Correspondence - Chamber of Commerce <br />Acting City Manager Williams read a letter from Mr. Bill McGuern, President Colton Chamber <br />of Commerce, dated July 22, 1974, informing the Council members that the Board of Directors <br />had decided to co-sponsor the Miss American Western Regional Tournament on August 16, 17, and <br />18. <br />The letter stated the Chamber of Commerce has committed itself as follows: Do all possible to <br />help advertise in newspapers, radio and television locally and outside our city, pay all <br />umpires fees for the tournament, on Sunday, August 18, during the championship game at Municipal <br />Park they will have an awards barbeque for all nine teams, their coaches and assistant coaches, <br />and the umpires and any regional officials that are from out of town. <br />Councilwoman Spragins asked if the parents of the youngster participating in the tournament <br />would also be included in the free barbeque. <br />Mr. McGuern stated that the Chamber would not be able to feed the parents free of charge as <br />they have estimated they can only afford to feed approximately 200 people free. <br />Sewage Service Agreement <br />Community Service Director Young reported that much hard work has gone into this agreement over <br />a long period of time and has involved himself, Planning Director Williams, Engineering Con- <br />sultant Burnett and Mr. Joe Kicak of Grand Terrace community. <br />Mr. Young went through the agreement explaining the various sections. <br />Mr. Young stated the first page basically sets up the sewer service area and defines the <br />areas. The second page, Mr. Young said, Right Of Use, provides Grand Terrace District to <br />connect to Colton's Trunk Line as indicated on Exhibit "B" attached to the agreement, or <br />at such other place in the system mutually agreed upon between the parties. <br />Mr. Young continued as follows: Authorized Right to Discharge provides for the District to <br />discharge into Colton's system sewage emanating from within the District boundaries delineated <br />on Exhibit "A" map. Ownership And Maintenance Of Facilities In The District provides that all <br />sanitary sewer system and truck lines constructed by the District shall be owned by the <br />District, however, they shall be operated and maintained by Colton. <br />Controls And Rights As To Use establishes regulations and controls so as to insure proper use <br />by the District of the sanitary system and trunk lines. The regulations give the City of Colton <br />the right to review plans and construction; right of inspection as the manner in which the <br />District is using the District s sanitary sewer system and both parties may examine the books, <br />records, accounts and accounting regards of the other relative to the operation and mainte- <br />nance of the other party's sewage system; prohibits illegal connections and defines waters <br />that the District shall not permit to be introduced into the District's sanitary sewer system; <br />Discharge Limitations (Quality) prohibits the District from discharging (causing or permitting) <br />into any of Colton's trunk sewers any waters or waste of such nature so as to violate Colton's <br />present or future Waste Discharge Requirements as imposed by Regional Water Quality Control <br />Board or Federal agencies; Control Manholes and Metering Devices states the District shall con- <br />struct manholes and install meters at their expense. <br />Mr. Young further explained: Payments to Colton 'By The District states the District agrees to <br />pay to Colton for the rights of use granted the following amounts: (a) Sewer Treatment Plant <br />Capacity - the district shall pay to Colton $100 for each connection to the Sewer System in the <br />District, the formula is shown on Page 6 of the Agreement and the parties agree to set a $100 <br />connection charge as predication upon the actual cost to Colton of its present sewer plant <br />expansion, however, Mr. Young stated that complete costs on the plant expansion are not yet <br />available and adjustments have been set up either for rebate if cost is less or for the actual <br />cost if $100 is not sufficient. <br />(b) Cost of Capacity in Colton's La Cadena Drive Trunk Line, the District agrees to pay Colton <br />the sum of $73,001.87 as and for its right to capacity in said trunk line and the sum of <br />$35,459.23 for its rights to capacity in said pump station; further, the District shall con- <br />struct the pumping facilities and other pertinent equipment needed for the capacity of the <br />District and Colton, the costs of such improvements will be on the pro -rata share of needs <br />of each party. <br />(c) The Cost to the District for capacity in the Washington Street line shall be.$10,440. <br />(d) Future Connections and Connection Charges, it is agreed that all the properties in the <br />District have the right to connect tb the system constructed under these proceedings and any <br />system constructed thereafter and transmit sewage through Colton trunk lines and pump station <br />without additional payment by the District for capacity to Colton in the Colton trunk lines <br />JUL 2 2 1974 <br />
