<br />Tract No. 9811
<br />Mr. Young requested Council consideration and approval of Tract No. 9811, contingent upon receipt of bonds or
<br />acceptable letter of credit from the developer, MARTRANS, for a 58 -unit Planned Unit Development to be located
<br />at the southeast corner of Barton Road and Mojave.
<br />Mr. Young advised the developer has signed the subdivision agreement and the necessary signatures have been
<br />obtained on the subdivision map.
<br />Moved by Councilwoman Cisneros, seconded by Councilman Rehrer, approving Tract No. 9811, contingent upon
<br />receipt of bonds or acceptable letter of credit from the developer, MARTRANS. Vote was unanimous.

<br />Mr. Young read his memorandum dated April 15, 1977, requesting Council approval of the City's report, required
<br />under Section 2156 of the Streets and Highways Code, containing the data that may be necessary to detail
<br />progress and needs for its road and street system, to be forwarded to the California Department of Transporta-
<br />tion (CALTRANS).
<br />Mr. Young stated if Council concurs with the report as submitted, it would be in order to approve Resolution
<br />No. 3679, approving the Section 2156 Report for transmission to CALTRANS.
<br />*Mayor Beltran entered the Council Chambers at 7:55 p. m.
<br />Moved by Councilman Hayes, seconded by Councilwoman Cisneros, to approve Section 2156 Report and Resolution
<br />No. 3679. Motion carried, Mayor Beltran abstained from voting.

<br />Water Quality Control Plant
<br />Ordinance No. 1515
<br />Mr. Young reported from his memorandum dated April 15,
<br />regulate the discharge of waste into the sewage system,
<br />Water Quality Control Board, Santa Ana Region.
<br />regarding consideration and approval of an ordinance to
<br />to comply with discharge requirements of the Regional
<br />Councilman Rehrer was concerned with how this ordinance will effect certain businesses.
<br />Mr. Young stated that the businesses will be properly notified and asked to conform with the ordinance, as
<br />required by the Water Quality Control Board.
<br />Mayor Beltran asked what would be the fine should the City not adopt such an ordinance.
<br />Mr. Young replied that the fine could be up to $10,000 per day.

<br />Moved by Councilman Gonzales, seconded by Councilwoman Cisneros, to adopt Ordinance No. 1515. Motion carried,

<br />WASTES INTO THE SEWERAGE SYSTEM OF THE CITY OF COLTON AND REPEAL-
<br />ING ORDINANCE NO. 13669 AN ORDINANCE REGULATING THE USE OF THE
<br />SEWERAGE AND DRAINAGE SYSTEM OF THE CITY OF COLTON.
<br />CITY MANAGER'S REPORTS AND RECOMMENDATIONS:

<br />Moved by Councilman Hayes, seconded by Councilwoman Cisneros, to deny Claim of Ernest A. Alvarez versus the
<br />City of Colton, as recommended by the insurance administrator. Vote was unanimous.
<br />Labor Relations
<br />Acting City Manager Johnsen reported from his memorandum dated April 19, regarding the Impasse Hearing held
<br />April 5, with the San Bernardino Public Employees Association, and determination as to recognizing SBPEA as
<br />representatives of the modified General Employees unit, outlined in the Rules and Regulations to implement
<br />Resolution No. 2996.
<br />EXECUTIVE SESSION:
<br />The City Council adjourned to Executive Session at 8:10 p. m., on the request of Councilman Hayes, to discuss
<br />Personnel Matters, and reconvened at 8:43 p. m., all Members present.
<br />Mr. Johnsen continued that since the meeting held April 5, the San Bernardino Public Employees Association has
<br />submitteda petition together with other related documents for exclusive recognition in the modified General
<br />Employees Unit, which has been validated by a conciliator from the State Conciliation Service, in accordance
<br />with the Rules and Regulations implementing Resolution No. 2996.
<br />Mr. Johnsen requested that the City Council direct the City Clerk to conduct a secret ballot election in the
<br />modified General Employees Unit between AFSCME and SBPEA, as provided in the Rules and Regulations to implement
<br />Resolution No. 2996.
<br />Mr. Richard C. Stearns, General Manager of the San Bernardino Public Employees Association, stated the Associa-
<br />tion is still very much concerned with that portion of the City's Resolution which seemingly allows an employee
<br />organization with less than a majority of the effected employeees to decertify an incumbent organization, as
<br />interpreted by the Acting City Manager. Mr. Stearns said this determination, in effect, requires the incumbent
<br />organization to requalify.
<br />Mr. Stearns continued he does not feel that anyone could support the fact that an organization representing
<br />less than half of the general employees could, in fact, decertify the incumbent organization, and he further
<br />feels that the City Council should direct themselves to that point and that it should be clarified.
