75 <br />City Clerk Ramos submitted the Affidavit of Mailing and reported that no protests <br />or objections had been received. <br />Community Services Director Earl Young stated the establishment of an underground <br />utility district is being proposed in conjunction with the development of the <br />Cooley Ranch, and completion of Mt. Vernon Avenue, as outlined in the proceedings <br />of Assessment District No. 78-1. Mr. Young stated the boundaries of the under- <br />ground utility district are south Mt. Vernon Avenue, north of Washington Street <br />and south of Cooley Lane. <br />Mr. Young concluded if there are no protests to the establishment of the under- <br />ground utility district, Staff would recommend approval of Resolution No. 3828. <br />Mayor Gonzales asked if anyone desired to speak on this matter. <br />Moved by Councilman Rehrer, seconded by Councilwoman Cisneros, to terminate <br />the Public Hearing. Vote was unanimous. <br />Moved by Councilwoman Cisneros, seconded by Councilman Rehrer, to approve Resolu- <br />tion No. 3828. Unanimous vote. <br />RESOLUTION NO. 3828 - ESTABLISHING UNDERGROUND UTILITY DISTRICT - MT. VERNON <br />AVENUE. <br />EXECUTIVE SESSION: <br />The City Council adjourned to Executive Session at 8:10 p. m., to discuss matters <br />of Litigation, and reconvened at 8:36 p. m., all Members present. <br />Sewage Treatment Agreement <br />Moved by Councilman Rehrer, seconded by Councilman Hayes, that the City Council <br />authorizes the City Manager and Special Legal Counsel, Best, Best and Krieger, <br />to meet and confer with the Chief Administrative Officer, and the County Council, <br />of San Bernardino County to negotiate immediate revisions to the Sewage Trans- <br />portation Treatment and Disposal Service Agreement between the City and the <br />County; if the County is not willing to undertake such negotiations in good <br />faith and timely fashion, and in light of the County's continuing breech of <br />the Agreement, see City of Colton letter dated April 27, 1978, the City Manager <br />and Special Legal Counsel are further authorized to take all additional legal <br />steps necessary to protect the City and to insure the fair and efficient opera- <br />tion of the City's Water Waste and Treatment facility. Vote was unanimous. <br />PLANNING COMMISSION REPORTS AND RECOMMENDATIONS: <br />AnnPxatinnq <br />Planning Director Benny Gonzales requested Council's consideration and approval <br />of two resolutions of application for proposed annexations, one to be known as <br />Colton Annexation North 15, consisting of approximately 10 acres located at the <br />west end of Citrus Street, north of Paul J. Rogers School, Resolution No. 3824; <br />and the other to be known as Colton Annexation East 30, consisting of approxi- <br />mately 85 acres located along the Southern Pacific Railroad, west of Hunts Lane, <br />south of the San Bernardino Freeway (I-15), and easterly of the Riverside Free- <br />way (I-10), Resolution No. 3825.L - <br />Mr. Gonzales advised that both of the proposed annexations are located within <br />the City of Colton's Sphere of Influence. <br />Moved by Councilman Rehrer, seconded by Councilman Hayes, to approve RESOLUTION <br />NO. 3824 (Colton Annexation North 15), and RESOLUTION NO. 3825 (Colton Annexation <br />East 30). Vote was unanimous. <br />COMMUNITY SERVICES DIRECTOR'S REPORTS AND RECOMMENDATIONS: <br />Agreements <br />Community Services Director Earl Young presented to the Council Members for con- <br />sideration and approval a proposed agreement between the City of Colton and the <br />Riverside Highland Water Company, in conjunction with Assessment District No. <br />78-1, which would allow the City to make certain modifications to Riverside <br />Highland Water Company's wells No. 4 and No. 4-A, which are required because <br />of street construction. <br />JUN 71978 <br />
