205 <br />Moved by Councilman Rehrer, seconded by Councilman Hayes, that the City of Colton <br />accepts the Lawrence A. Hutton Community Center and the Peter S. Luque Multi -Service <br />Center as being ready for occupancy. <br />Councilmen Rehrer and Temby questioned the over -run of the contract and the fees <br />involved. <br />City Attorney Edwards stated it is Staff's analysis that the contractor did not over- <br />run the contract. The question concerns completion of the contract; our architect <br />states that the contractor completed these projects during the time limit and Staff <br />concurs with that. <br />Upon Roll Call, the Vote was: <br />AYES: Four; Hayes, Cisneros, Rehrer, Gonzales. <br />NOES: None. <br />ABSENT: None. <br />ABSTAIN: One; Temby. <br />City Attorney Edwards asked if the City Council also approves executing the Notice <br />of Completion for recording. <br />Councilman Rehrer stated he did not have that in his motion and would not recommend <br />or approve the signing of the Notice of Completion until these questionable items <br />as outlined in the list of change orders are clarified and complied with. <br />Mr. Edwards advised that the terms of the agreement between the City and the Contrac- <br />tor are. that at such time as the work is accepted, a Notice of Completion will be <br />signed and recorded, and further that there is an installment payment due to the <br />Contractor. Mr. Edwards stated, therefore, he would like the City Council to clari- <br />fy what it would have Staff do - that is, do we pay the requested installment -payment <br />of some $9,000, which has been submitted by the contractor and approved by our archi- <br />tect. <br />Moved by Councilman Rehrer, seconded by Councilman Hayes, to refuse the signing of <br />the Notice of Completion on the two Community Centers until there is an explanation <br />on the change orders, the expenditures, and the time allotted on the contract. <br />City Attorney Edwards asked Councilman Rehrer with regard to the pay request, does <br />the motion intend to deny the current pay request of the contractor? <br />Councilman Rehrer responded yes. Motion carried. Councilman Temby abstained. <br />Building and Safety Director John Twiss read in full a memorandum dated February 13, <br />1979, from himself to the Mayor and City Council, stating he would like to clarify <br />to the Council and general public what his position has been since he was assigned <br />the numerous duties and tasks connected with the construction and completion of the <br />two Centers. Mr. Twiss concluded he felt it was very unfortunate that the City <br />Council took the position of not accepting and occupying the Centers months ago, <br />because the discrepancies could have been corrected while both Centers were in use. <br />Mayor Gonzales stated that inasmuch as the Centers have now been accepted for oc- <br />cupancy, he would recommend the Council take action on the matter pertaining to <br />the stainless steel wall covering behind the cooking range at the Lawrence A. <br />Hutton Community Center to comply with health, safety and fire regulations, as <br />discussed at a previous meeting. <br />Moved by Councilman Hayes, seconded by Councilman Rehrer, to install a stainless <br />steel wall covering behind the cooking range at the Lawrence A. Hutton Community <br />Center at an estimated cost of $496 from Food Equipment Fabricators, amount to be <br />allocated from the General Fund. Vote was unanimous. <br />Li brary <br />JV Mayor Gonzales read a memorandum from City Librarian, Martine Hornburg, requesting <br />`( Council's consideration and approval to replace the furnace at the Library, which <br />is inoperative and cannot be repaired, at an estimated cost of $1,922. Mayor <br />Gonzales advised that this expenditure is not budgeted. <br />After discussion among Council Members and Staff, moved by Councilman Temby, seconded <br />by Councilman Rehrer, approving replacement of furnaces at the City Library at a cost <br />of $1,922, as outlined.
