Mr. Max Hopkins, representing Wight -Hopkins Development Company, stated they are in agreement, regarding their property, with the City if the City will relocate their easement to correspond with future development of the property. Upon Roll Call, the Vote was: AYES:. Five; Hayes, Cisneros, Temby, Rehrer, Gonzales. NOES: None. ABSENT: None. Motion carried unanimously. RESOLUTION NO. 3978 - RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COLTON DECLAR- ING THAT THE ACQUISITION FOR PUBLIC USE OF FEE SIMPLE INTER- ESTS IN REAL PROPERTY, AN EASEMENT FOR ROAD AND UTILITIES PURPOSES AND RIGHTS-OF-WAY UPON AND ACROSS CERTAIN REAL PROPERTY BY EMINENT DOMAIN IS NECESSARY FOR THE INSTALLA- TION OF CERTAIN PUBLIC STREET IMPROVEMENTS. Mayor Gonzales announced that a letter has been received from the San Bernardino Public Employees Association requesting that this public hearing be continued until such time as the City has met and conferred with the Association regarding the new classification. Moved by Councilman Hayes, seconded by Councilman Rehrer, to continue the Public Hearing, to consider amendments to the Personnel Rules and Regulations for the City of Colton, Rule II Section 3, Administrative Assistant/Personnel (Unclassified) to Tuesday, February 19, 1980. Unanimous vote. Zoning P. C. Res. No. 930 Mayor Gonzales declared the Public Hearing open. City Attorney Edwards advised that since the beginning of the prezoning for Annexa- tion East 32, Index No. A-12-79, there have been some changes and the Local Agency Formation Commission has had additional proceedings. Mr. Edwards stated that due to a recent decision of the L.A.F.C., that the annexa- tion of the subject property encompass a larger area, it is no longer feasible to proceed with Annexation East 32. Moved by Councilman Hayes, seconded by Councilman Rehrer, to abandon the matter con- cerning the prezoning of Annexation East 32 until. a future date. Unanimous vote.
