166 <br />Building Code Violations <br />Ord. No. 0-27-89 <br />City Manager Leslie Keane reported on a proposed urgency ordinance and <br />resolution which will establish a process and fees for building re -in- <br />spections, which arise from inferior workmanship requiring numerous in- <br />spections and re -inspections in order to establish Code compliance. <br />Ms. Keane continued when workmanship problems are not related to Code _ <br />violations, the City has limited legal ability to assist homeowners <br />recover damages or to assure repairs. The City can, however, increase <br />the number and levels of inspections performed, adopt fees for re-inspec <br />tions, file complaints with appropriate regulatory agencies and require <br />additional safeguards on new development. <br />Ms. Keane said Staff is proposing that the Council authorize Staff to <br />file a formal complaint against Nordic Development Company with the <br />Contractors' State License Board, adopt Urgency Ordinance No. 0-27-89, <br />establishing a process for building re -inspections, and approve Resolu- <br />tion No. R-163-89, establishing fees on an hourly basis. <br />Ms. Keane concluded in addition to these actions, Staff will be review- <br />ing the subdivision agreements associated with Paradise Hills and other <br />tracts within the City, and would propose to take all appropriate actions <br />allowed by these agreements to assure performance. <br />Mr. Robert Sparks, 3029 Prado Lane, stated he would like the Petition <br />that was submitted with the residents' letter, dated December 8, 19899 <br />to be entered into the City's records. Mr. Sparks said there were ap- <br />proximately 34 names on the Petition. <br />Mrs. Brenda Procel, 3035 Prado Lane, also spoke to the Council with re- <br />gard to her residence in the Paradise Hills tract, the poor workmanship <br />and condition of her home, and the many problems that exist in their - <br />tract. <br />After additional discussion between residents and Staff, moved by <br />Councilwoman Cisneros, seconded by Councilman Rios, to waive full read- <br />ing and adopt Ordinance No. 0-27-89. Upon Roll Call, the Vote was <br />unanimous. <br />ORDINANCE NO. 0-27-89 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br />COLTON, AMENDING ORDINANCE NO. 0-32-889 OF THE <br />CITY OF COLTON, PERTAINING TO RE -INSPECTIONS, <br />REPEATED INSPECTIONS, INFERIOR WORKMANSHIP, <br />FAILURE TO ADEQUATELY ADDRESS WORKMANSHIP ISSUES, <br />AND DECLARING THE URGENCY THEREOF. <br />Moved by Councilwoman Cisneros, seconded by Councilman Lofy, to adopt <br />Resolution No. R-163-89. Unanimous vote. <br />RESOLUTION NO. R-163-89 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY <br />OF COLTON, CALIFORNIA, ESTABLISHING FEES FOR <br />INSPECTION SERVICES PROVIDED IN CONJUNCTION <br />WITH CITY OF COLTON ORDINANCE NO. 0-27-89. <br />Community Facilities District No. 89-1 <br />City Manager Leslie Keane reported on consideration of resolutions <br />authorizing the issuance and sale of bonds for Community Facilities <br />District No. 89-1 in order to proceed with the financing for improve- <br />ments in the District. <br />Ms. Keane said Staff is recommending the selection of Union Bank as the <br />fiscal agent for this issue, and to accept and approve the proposal re- <br />ceived from Sutro & Company, with the net interest rate of 7.5400%. <br />Ms. Keane concluded Staff recommends the Council authorize the selection <br />of Union Bank as fiscal agent for $3 million in Series 1989 Bonds to be <br />issued under the auspices of Community Facilities District No. 89-1, and <br />adopt Resolution Nos. R-161-89 and R-162-89, authorizing the sale of <br />bonds on behalf of Community Facilities District No. 89-1. <br />DEC 19 1989 <br />
