SPECIAL MEETING OF THE CITY COUNCIL/REDEVELOPMENT AGENCY/COLTON UTILITY <br />AUTHORITY OF THE CITY OF COLTON <br />July 7, 2008 <br />A Special Meeting of the City Council/Redevelopment Agency/Colton Utility Authority of the City of <br />Colton was held at 6:03 p.m., on the above -given data in the Council Chambers of City Hall, located <br />at 650 North La Cadena Drive, Colton, California Mayor Chastain presiding. Notice of Special <br />Meeting was given on July 2, 2008, in compliance with Government Code Section 54956. <br />ROLL CALL: <br />Councilmembers present were Suchil, Mitchell, Oliva, Yzaguirre, Toro, and Mayor Chastain. Also <br />present were City Manager Parrish, City Attorney Martinez, and City Clerk Padilla. Councilmember <br />De La Rosa absent. <br />Said Special Meeting shall be for the purpose of studying and or taking action on the following <br />matters: <br />STAFF REPORTS: <br />CITY MANAGER REPORTS AND RECOMMENDATION <br />(1) Waive Further Reading, Read by Title only and Adopt an Urgency Ordinance of the City <br />Council of the City of Colton Regarding the Assumption of Responsibility for the Enforcement <br />of Parts 2.1 and 2.3 of Division 13 of the California Health and Safety Code and the <br />Provisions of Title 25, California Code of Regulations, Division 1, Chapters 2 and 2.2 <br />Relating to Inspection and Enforcement of Mobilehome Parks Regulations, URGENCY <br />ORDINANCE NO. 0-08-08. <br />And/Or <br />(2) Consideration and Approval of a Resolution Transferring Inspection and Enforcement <br />Responsibility Pursuant to the Mobilehome Parks Act and Special Occupancy Parks Act from <br />City of Colton to the California Department of Housing and Community Development (HCD), <br />RESOLUTION NO. R-72-08. <br />City Manager Parrish presented for council consideration approval of an Urgency Ordinance relating <br />to inspection and enforcement of Mobilehome Parks regulations. As outlined in the agenda report an <br />Urgency Ordinance and/or a Resolution would be recommended based on the number of Council <br />Members present. The urgency ordinance requires a "4/5" vote to pass, or a "super majority: vote. <br />City Manager Parrish outlined staff's recommendation that the City Council take one of the following <br />actions: (1) If at least six (6) Council Members are present at the Special Meeting, staff recommends <br />that the Council waive further reading, read by title only and adopt an urgency ordinance notifying <br />the Department of Housing and Community Development of the City's intent to cancel enforcement <br />responsibility of the Acts; or (2) If less than six (6) Council Members are present at the Special <br />Meeting, staff recommends that the Council adopt the proposed Resolution notifying the Department <br />of Housing and Community Development of the City's intent to cancel enforcement responsibility of <br />the Acts. <br />Motion/second by Mayor Pro Tempore Mitchell/CM Oliva to approve Urgency Ordinance No. 0-08- <br />08. Motion carried with Councilmember De La Rosa absent. <br />
