SETTLEMENT AND RELEASE AGREEMENT <br />A. This settlement and Release Agreement <br />("Agreement") is entered into by and between the City Of Colton <br />Max J. Lofy, Connie Cisneros, Leroy Rehrer,, and Adams <br />Advertising, Inc., ("Adams"), (collectively, "the parties") in <br />connection with a settlement of San Bernardino Superior Court <br />Case No. 268943 ("the Action"). <br />AGREEMENT <br />1. Notwithstanding any other action by the City Council <br />purportedly to the contrary, all variances and conditional use <br />its ("CUP's") previously granted to Adams with regard to the <br />perml <br />outdoor advertising signs covered by this Agreement are approved, <br />ratified, and acknowledged to be in full force and effect and <br />shall bet deemed to have been issued effective May 18, 1993. <br />2. The City Manager is authorized to take the following <br />action: <br />a) To enter into a lease agreement with Adams <br />containing substantially the same terms and <br />conditions as Exhibit A, which is attached hereto <br />and incorporated herein by this reference (the <br />"Lease").
