<br />AN ORDINANCE OF THE
<br />CITY COUNCIL OF THE CITY
<br />OF COLTON, AUTHORIZING
<br />AN AMENDMENT TO THE
<br />CONTRACT BETWEEN THE
<br />CITY COUNCIL AND THE
<br />BOARD OF ADMINISTRA-
<br />TION OF THE CALIFORNIA
<br />PUBLIC EMPLOYEES'
<br />RETIREMENT SYSTEM.
<br />SYSTEM.
<br />THE CITY COUNCIL OF THE
<br />CITY OF COLTON DOES ORDAIN
<br />AS FOLLOWS:
<br />SECTION 1. That an amendment
<br />to the Contract between the City
<br />Council of the City of Colton and the
<br />Board of Administration, California
<br />Public Employees' Retirement
<br />System is hereby authorized, a copy
<br />of said amendment being attached
<br />hereto, marked "Exhibit All, and by
<br />such reference made a part hereof
<br />as though herein set out in full.
<br />EXHIBIT A
<br />AMENDMENT TO CONTRACT
<br />BETWEEN THE BOARD OF
<br />ADMINISTRATION PUBLIC
<br />EMPLOYEES' RETIREMENT
<br />SYSTEM AND THE CITY
<br />COUNCIL OF THE CITY OF
<br />COLTON
<br />The Board of Administration,
<br />Public Employees' Retirement
<br />System, hereinafter referred to as
<br />Board, and the CITY COUNCIL of
<br />the CITY OF COLTON, hereinafter
<br />referred to as Public Agency, having
<br />entered into a contract under date of
<br />May 28, 1945, effective July 1, 1945,
<br />and as amended effective February
<br />1, 1948, July 1, 1954, January 1, 1960
<br />and September 1, 1962, and as
<br />provided by Chapter 170, Statutes of
<br />1971 and Chapter 316, Statutes of
<br />1971, which provides for par-
<br />ticipation of Public Agency in said
<br />System, Board and Public Agency
<br />hereby agree as follows:
<br />A. Paragraphs 1 through 9 are
<br />hereby stricken from said
<br />contract as executed effective
<br />July 1, 1945, and are hereby
<br />replaced by the following
<br />paragraphs numbered 1 through
<br />8 inclusive:
<br />1. All words and terms used
<br />herein which are defined in the
<br />Public Employees' Retirement
<br />Law shall have the meaning as
<br />defined therein unless otherwise
<br />specifically provided. "Normal
<br />retirement age" shall mean age
<br />60 for miscellaneous Group A
<br />members, age 60 for
<br />miscellaneous Group B mem-
<br />bers, and age 55 for local safety
<br />members.
<br />2. Public Agency shall par-
<br />ticipate in the Public Em-
<br />ployees' Retirement System
<br />from and after July 1, 1945,
<br />making its employees as
<br />hereinafter provided, members
<br />of said System subject to all
<br />provisions of the Public Em-
<br />ployees' Retirement Law except
<br />such as apply only on election of
<br />a contracting agency and are
<br />not provided for herein and to all
<br />amendments to said Law
<br />hereafter enacted except such
<br />as by express provisions thereof
<br />apply only on the election of
<br />contracting agencies.
<br />3. Employees of Public Agency
<br />in the following classes and
<br />groups shall become members
<br />of said Retirement System
<br />except such in each such class
<br />and group as are excluded by
<br />law or this agreement:
<br />a. Local firemen (herein
<br />referred to as local safety
<br />members) ;
<br />b. Local policemen (herein
<br />referred to as local safety
<br />members) ;
<br />c. Employees other than local
<br />safety members whose positions
<br />are not subject to Federal Social
<br />Security coverage (herein
<br />referred to as miscellaneous
<br />Group A members);
<br />d. Employees other than local
<br />safety members whose positions
<br />are subject to Federal Social
<br />Security coverage (herein
<br />referred to as miscellaneous
<br />Group B members).
<br />In addition to the employees
<br />excluded from membership by
<br />said Retirement Law, the
<br />following employees shall not
<br />become members of the
<br />Retirement System:
<br />EXCLUDE EMPLOYEES
<br />COMPENSATED ON AN
<br />HOURLY BASIS HIRED 9-1-62
<br />OR AFTER
<br />4. The following provisions
<br />shall apply to miscellaneous
<br />Group A members and local
<br />safety members.
<br />a. The fraction of final com-
<br />pensation to be provided for
<br />each year of credited prior and
<br />current service as a
<br />miscellaneous Group A member
<br />upon retirement at normal
<br />retirement age shall be 1-50 and
<br />shall be applied as provided in
<br />Section 21251.13 of said
<br />Retirement Law.
<br />b. The fraction of final com-
<br />pensation to be provided for
<br />each year of credited prior and
<br />current service as a local safety
<br />member shall be determined in
<br />accordance with Section 21252.1
<br />of said Retirement Law.
<br />c. Contribution rates of
<br />miscellaneous Group A mem-
<br />bers and local safety members
<br />shall be subject to Sections 20603
<br />and 20602, respectively.
<br />d. The following provisions of
<br />the Public Employees'
<br />Retirement Law which apply
<br />only upon election of a con-
<br />tracting agency shall apply:
<br />(1) Section 20952.5 (providing
<br />for age 50 as the minimum
<br />voluntary retirement age for
<br />local safety members with
<br />benefit payments commencing
<br />prior to age 55 subject to ac-
<br />tuarial discount).
<br />5. The following provisions
<br />shall apply to miscellaneous
<br />Group B members only:
<br />a. The effectivity of mem-
<br />bership in Group B shall be
<br />January 1, 1956 or later entry
<br />into employment as a
<br />miscellaneous member.
<br />b. The fraction of final com-
<br />pensation to be provided for
<br />each year of credited prior and
<br />current service upon retirement
<br />at normal retirement age shall
<br />be 1-50 and shall be applied as
<br />provided in Section 21351.13 of
<br />said Retirement Law subject to
<br />the modification set forth in
<br />subparagraph 5 (c) below.
<br />c. The fraction of final com-
<br />pensation specified in sub-
<br />paragraph (b) above shall be
<br />reduced by one-third for ap-
<br />plication to the first $400 per
<br />month of final compensation as
<br />to service in any period after
<br />January 1, 1956.
<br />d. the retiremenT benefits
<br />payable upon retirement for
<br />ordinary disability shall not be
<br />affected by the modification
<br />provided in paragraph 5 (c) of
<br />this contract as amended except
<br />that for the purposes of the limit
<br />on any such allowance imposed
<br />under Section 21297, Govern-
<br />ment Code, allowances for
<br />retirement for service shall be
<br />computed according to the
<br />modified formula set out in
<br />paragraph 5 (c) of the contract
<br />as amended. All other
<br />provisions of this contract shall
<br />be fully applicable to the
<br />computation of allowances upon
<br />retirement for disability.
<br />e. Contribution rates of
<br />miscellaneous Group B mem-
<br />bers shall be subject to Section
<br />20603 providing for a reduction
<br />in rates of contribution as such
<br />rates relate to the first 8400 of
<br />monthly compensation and 100
<br />percent of such rates as they
<br />apply to the remainder of
<br />monthly compensation.
<br />I. The following additional
<br />provisions of the Public Em-
<br />ployees' Retirement Law which
<br />apply only upon election of a
<br />contracting agency shall apply
<br />to Group B members:
<br />(1) That portion of Section
<br />21251.13 which provides for
<br />reduction in the percentage of
<br />final compensation for members
<br />covered under Social Security.
<br />6. Public Agency shall con-
<br />tribute to said Retirement
<br />System as follows:
<br />a. With respect to
<br />miscellaneous members, the
<br />public agency shall contribute
<br />the following percentages of
<br />monthly salaries earned as
<br />miscellaneous members of said
<br />System:
<br />(1) 7.15 percent on account of
<br />the liability for current service
<br />benefits, said percentage being
<br />fixed by Section 20750 of the
<br />Retirement Law.
<br />b. With respect to local safety
<br />members, the public agency
<br />shall contribute the following
<br />percentages of monthly salaries
<br />earned as local safety members
<br />of said System:
<br />(1) 0.003 percent until June 30,
<br />2000 on account of the liability
<br />for prior service benefits.
<br />(2) 9.586 percent on account of
<br />the liability for current service
<br />benefits.
<br />c. A reasonable amount per
<br />annum, as fixed byBoard to_
<br />cover the costs_ of ad
<br />ministering said System as it
<br />affects the employees of Public
<br />Agency, not including the costs
<br />of special valuations or of the
<br />periodical investigation and
<br />valuation required by law.
<br />d. A reasonable amount as
<br />fixed by the Board, payable in
<br />one installment as the occasions
<br />arise, to cover costs of special
<br />valuations on account of em-
<br />ployees of Public Agency, and
<br />costs of the periodical in-
<br />vestigation and valuation
<br />required by law.
<br />7. Contributions required of
<br />Public Agency and its em-
<br />ployees shall be subject to ad-
<br />justment by Board on account of
<br />amendments to the Public
<br />Employees' Retirement Law,
<br />and on account of experience
<br />under the Retirement System,
<br />as determined by the periodical
<br />investigation and valuation
<br />required by said Retirement
<br />Law.

<br />Public Agency and its em-
<br />ployees shall be paid by Public
<br />Agency to the Retirement
<br />System within thirty days after
<br />the end of the period to which
<br />said contributions refer. If more
<br />or less than the correct amount
<br />of contribution is paid for any
<br />period, proper adjustment shall
<br />be made in connection with
<br />subsequent remittances, or
<br />adjustments on account of
<br />errors in contributions required
<br />of any employee may be made
<br />by direct cash payments bet-
<br />ween the employee and Board.
<br />Payments by Public Agency to
<br />Board may be made in the form
<br />of warrants, bank checks, bank
<br />drafts, certified checks, money
<br />orders, or cash.
<br />B. This amendment shall be
<br />attached to said contract and
<br />shall become effective on the
<br />2nd day of February, 1973.

<br />SECTION 2. The Mayor of the City
<br />Council is hereby authorized, em-
<br />powered, and directed to execute
<br />said amendment for and on behalf of
<br />said Agency.
<br />SECTION 3. This Ordinance shall
<br />take effect 30 days after the date of
<br />its adoption, and prior to the ex-
<br />piration of 15 days from the passage
<br />thereof shall be published at least
<br />once in the Colton Courier, a
<br />newspaper of general circulation,
<br />published and circulated in the City
<br />of Colton and thenceforth and
<br />thereafter the same shall be in full
<br />force and effect.
