1 <br />2 <br />3 <br />4 <br />5 <br />6 <br />7 <br />8 <br />9 <br />10 <br />11 <br />12 <br />13 <br />14 <br />15 <br />16 <br />17 <br />18 <br />19 <br />20 <br />21 <br />22 <br />23 <br />24 <br />25 <br />26 <br />27 <br />28 <br />29 <br />30 <br />31 <br />32 <br />ORDINANCE NO. 1493 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br />COLTON REGULATING STORAGE, USE AND SALE OF SAFE <br />AND SANE FIREWORKS WITHIN SAID CITY. <br />THE CITY COUNCIL OF THE CITY OF COLTON DOES ORDAIN AS FOLLOWS: <br />SECTION I: Ordinance No. 612 and Sections 6.32.010 and 6.32.020 of <br />the Colton Municipal Code are hereby repealed. <br />SECTION II: There is hereby added to Chapter 6.32 of the Colton <br />Municipal Code the following sections. <br />SECTION ONE: Safe and Sane Fireworks as defined by Section 12504 of <br />the Health and Safety Code of the State of California may be sold and discharged <br />within the City of Colton during the period beginning at 12:00 o'clock noon on <br />the 28th day of June ending at 12:00 o'clock midnight on the 5th day of July <br />each year pursuant to the provisions of this ordinanance and not otherwise. <br />SECTION TWO: FIREWORKS - SALE OF - LICENSE REQUIRED. <br />Except as provided herein, no person shall offer for sale or sell at <br />retail any fireworks of any kind in said City without having first applied for <br />and received a license therefor. <br />SECTION THREE: APPLICATION FOR A LICENSE. <br />Applications for a license to sell fireworks shall: <br />A. Be made in writing accompanied by a license fee of $50.00. The <br />fee is not for the purpose of revenue but will be used to defray <br />the cost of inspection and supervision. <br />B. Be made between the first day and the last day of March of each <br />year except when the last day falls on a Saturday or Sunday, the <br />following business day shall be determined to be the last day. <br />C. Set forth the proposed location of the fireworks stand applied f <br />The stands must be on private property located in "C-1" or heavi <br />industrial or manufacturing zones and the written permission of <br />the owner of record or lessee must accompany the application. <br />D. Be accompanied by an assurance that if the license is issued to <br />applicant, applicant shall, at the time of receipt of said <br />license, deliver to the Department of Finance of said City <br />$100,000/$300,000 public liability and $50,000 property <br />
