Prohibition Against the Display of Private Parts. <br />Every person shall be guilty of a misdemeanor who exposes his or her private <br />parts, buttocks, genitals, pubic hair, natal cleft, or perineum or employs any <br />device which, through covering such parts, is intended to simulate the same <br />while participating in any live act, demonstration, or exhibition in any public <br />place, place open to the public, place open to public view, or while serving <br />food or drink, or both, to any customer. <br />Section 9.11.050. Permitting, Procuring, or Assisting Any Person <br />in Violating Sections 9.11.030 and 9.11.040 Prohibited. Any person who employs, <br />procures, permits, or assists any person to engage in conduct prohibited by the <br />provisions of Sections 9.11.030 or 9.11.040 of this Chapter shall be guilty of <br />a misdemeanor. <br />Section 9.11.060. Exceptions. The provisions of this Chapter shall <br />not apply to: <br />(a) A theater, concert hall, or other similar establishment which <br />lis primarily devoted to theatrical performances; or <br />(b) Any act authorized or prohibited by any statute of the State. <br />Section 9.11.070. Severability. It is hereby declared that it is <br />the intention of the City Council that the Sections paragraphs, sentences, <br />clauses, and phrases of this Chapter are severable, and if any phrase, clause, <br />sentence, paragraph, or Section of this Chapter is declared unconstitutional by <br />any valid judgment or decree of a court of competent jurisdiction, such uncon- <br />stitutionality shall not affect any of the remaining phrases, clauses, sentences <br />paragraphs, and Sections of this Chapter or this Code. <br />Section 9.11.080. Violations of Provisions: Penalties. Any act <br />made a misdemeanor by the provisions of this Chapter shall, upon conviction, be <br />punishable by a fine of not to exceeu rive Hundred and no/100ths (.$x500.00) <br />- 2 - <br />
