VERNON CORRIDOR REDEVELOPMENT PROJECT AND AUTHORIZING RECORDING OF A REVISED STATEMENT OF PROCEEDINGS RECITALS A. In accordance with the provisions of the California Community Redevelopment Law (Health and Safety Code Sections 33000, et seq.), the City Council of the City of Colton, California ("City Council"), established the Redevelopment Agency for the City of Colton ("Agency"); B. Pursuant to Ordinance No. 0-8-87, adopted on June 30, 1987, the City Council approved the Mt. Vernon Corridor Redevelopment Project Redevelopment Plan ("Redevelopment Plan"). The lands subject to the Redevelopment Plan are referred to as the "Project Area"; C. The Agency is engaged in activities necessary to execute and implement the Redevelopment Plan; D. Pursuant to new Health and Safety Code Section 33342.7, before July 1, 2007, the City Council is required to adopt an ordinance describing the Agency's eminent domain program ("Eminent Domain Program") under the Redevelopment Plan; E. Pursuant to new Health and Safety Code Section 33373 the Agency must record in the official records of the County of San Bernardino, California, a revised statement that proceedings for the redevelopment of the Project Area have been instituted ("Statement of Proceedings"), including a description of the lands subject to the Redevelopment Plan and describing the provisions of the Redevelopment Plan regarding exercise of the power of eminent domain; F. Health and Safety Code Section 33373(d) requires the recordation of such a revised Statement of Proceedings prior to the Agency's commencement of any future eminent domain action under the Redevelopment Plan; G. The Redevelopment Plan authorized the Agency to acquire certain real property within the Project Area by exercise of the power of eminent domain for twelve (12) years following the effective date of the Ordinance approving and adopting the Redevelopment Plan; H. The last date on which the Agency could acquire property by exercise of the power of eminent domain pursuant to the Redevelopment Plan was June 30, 1999; I. The City Council intends to promote effective redevelopment, without abuse of the power of eminent domain; -1-
