The Agency is authorized, however, to acquire property devoted to a public use; Real property to be retained by an owner, either as a conforming owner or pursuant to a participation agreement, if the owner fully performs under the agreement; or Real property on which an existing building is to be continued on its present site and in its present form and use may not be acquired by eminent domain without the consent of the owner unless: (a) The building requires structural alterations, improvements, modernization or rehabilitation; (b) The site or lot on which the building is situated required modification in size, shape or use; or (c) It is necessary to impose upon such property any of the standards, restrictions and controls of this Plan, and the owner fails or refuses to participate in this project by executing an Owner Participation Agreement. Other provisions of this section notwithstanding, the Agency shall not acquire from any of its members or officers any property or interest in property except through eminent domain proceedings. Section 6. Further, the Agency shall comply with the relocation requirements of Sections 331, 332, 333, and 334 of the Amended Redevelopment Plan and the replacement housing requirements of Section 410 of the Amended Redevelopment Plan, whenever applicable to the Agency's exercise of the power of eminent domain pursuant to the Amended Redevelopment Plan. Section 7. The Mayor is hereby authorized and directed to sign this Ordinance. Section 8. The City Clerk is hereby authorized and directed to send a certified copy of this Ordinance to the Agency, whereupon the Agency shall be vested with the continuing responsibility for carrying out the Amended Redevelopment Plan. Section 9. The City Clerk is hereby further authorized and directed to file the Statement of Proceedings attached to this Ordinance as Exhibit "A" with the office of the Recorder of the County of San Bernardino, California, for recordation in the official records of the County of San Bernardino, California, in accordance with Government Code Section 27295 and Health and Safety Code Section 33373. Section 10. The City Clerk is hereby further authorized and directed to file a Notice of Exemption with the appropriate official of the County of San Bernardino, California, 52
