2 <br />3 <br />4 <br />6 <br />7 <br />8 <br />9 <br />10 <br />11 <br />12 <br />13 <br />14 <br />15 <br />16 <br />17 <br />18 <br />19 <br />20 <br />21 <br />22 <br />23 <br />24 <br />25 <br />26 <br />27 <br />28 <br />WHEREAS, the City of Colton desires to adopt the California Building Standards <br />Code as adopted by the State of California Building Standards Commission in Title 24 of the <br />California Code of Regulations (collectively "the Codes"), with necessary amendments to assure <br />the Codes are tailored to the particular safety needs of the City of Colton as required by its unique <br />climatic, topographic and geologic conditions; and <br />WHEREAS, Title 25, section 52 of the California Code of Regulations empowers <br />the City to use its own abatement procedures so long as these procedures are equivalent to the <br />procedures contained in Title 25 sections 48 through 70 of the California Code of Regulations, <br />and provided such procedures provide an efficient and effective procedure for the abatement of <br />substandard conditions with fairness to both owners and residents; and <br />WHEREAS, the Uniform Code for the Abatement of Dangerous Buildings <br />provides efficient and effective procedures for the abatement of substandard buildings, structures <br />and nuisances that are fair and equitable to both owners and residents and are equivalent to the <br />procedures contained in Title 25 of the California Code of Regulations to serve the purpose <br />intended therein; and <br />WHEREAS, the City held a public hearing on November 20, 2007 at which time <br />all interested persons had the opportunity to appear and be heard on the matter of adopting the <br />California Building Standards Code and other uniform codes as amended herein; and <br />WHEREAS, the City published notice of the aforementioned public hearing <br />pursuant to California Government Code Section 6066 on November 6, 2007 and November 14, <br />2007; and <br />WHEREAS, any and all other legal prerequisites relating to the adoption of this <br />Ordinance have occurred; <br />THE CITY COUNCIL OF THE CITY OF COLTON DOES HEREBY ORDAIN AS <br />FOLLOWS: <br />SECTION 1. Findings. The City Council hereby finds that the proposed <br />amendments to the California Building Standards Code (California Code of Regulations, Title 24) <br />adopting the CBC, CMC, CPC, CEC, and CFC, are reasonably necessary because of local <br />climatic, geologic or topographic conditions. This finding is supported and based upon the <br />following express findings and determinations, followed by the applicable amendments: <br />1. The City experiences relatively low amounts of precipitation, very <br />low humidity levels and extremely high temperatures. These climatic conditions are conducive to <br />the spread of drought conditions and fires. For example, during the summer months temperatures <br />often exceed 100 degrees Fahrenheit. During these months humidity is usually less than 40% and <br />measurements of less than 10% relative humidity are not uncommon. These conditions <br />contribute to an increased likelihood of fire. Moreover, minor fires have a greater tendency of <br />spreading rapidly due to such conditions. <br />Applicable Code Amendments: CBC & CFC 903.2, 903.2.1, 903.2.1.1, 903.2.1.2, 903.2.1.3, <br />-2- <br />
