Thus, the conditions which led to the adoption and extension of these <br />moratorium ordinances are no longer present as the City and the City's land <br />use consultants cannot proceed to master plan within the Regional Park Study <br />Area when the linchpin of these efforts, the Regional Park, will not be part of <br />the Master Plan. <br />F. California Government Code Section 36937 authorizes the City Council to <br />adopt by four-fifths vote, an urgency ordinance for the immediate preservation <br />of the public peace, health or safety that becomes effective immediately; <br />G. As a result, and in order to address the effects of having a moratorium in place <br />for an additional 4 months, the City Council of the City of Colton finds that <br />repeal of the moratorium would promote the public peace, health and safety by <br />repealing the building restrictions established by the moratorium ordinances <br />and allowing the uses that were previously authorized by the underlying zoning <br />designations. <br />SECTION 2. Repeal of Moratorium Ordinance No. The City Council of the City of <br />Colton hereby repeals Urgency Ordinance No. 0-01-08 and the land use entitlement and <br />permit restrictions imposed therein for the Regional Park Study Area described in the attached <br />Exhibit A. <br />SECTION 3. Compliance with California Environmental Quality Act. The City <br />Council finds that this Urgency Ordinance is not subject to the California Environmental <br />Quality Act (CEQA) pursuant to Sections 15060(c)(2) (the activity will not result in a direct <br />or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the <br />activity is not a project as defined in Section 15378) of the CEQA Guidelines, California <br />Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical <br />change to the environment, directly or indirectly. <br />SECTION 4. Effective Date. This Urgency Ordinance was adopted by the necessary <br />four-fifths vote of the members of the City Council pursuant to California Government Code <br />Section 65858, and shall take effect immediately upon its adoption. <br />SECTION 5. Publishing.
