Thus, the conditions which led to the adoption and extension of these moratorium ordinances are no longer present as the City and the City's land use consultants cannot proceed to master plan within the Regional Park Study Area when the linchpin of these efforts, the Regional Park, will not be part of the Master Plan. F. California Government Code Section 36937 authorizes the City Council to adopt by four-fifths vote, an urgency ordinance for the immediate preservation of the public peace, health or safety that becomes effective immediately; G. As a result, and in order to address the effects of having a moratorium in place for an additional 4 months, the City Council of the City of Colton finds that repeal of the moratorium would promote the public peace, health and safety by repealing the building restrictions established by the moratorium ordinances and allowing the uses that were previously authorized by the underlying zoning designations. SECTION 2. Repeal of Moratorium Ordinance No. The City Council of the City of Colton hereby repeals Urgency Ordinance No. 0-01-08 and the land use entitlement and permit restrictions imposed therein for the Regional Park Study Area described in the attached Exhibit A. SECTION 3. Compliance with California Environmental Quality Act. The City Council finds that this Urgency Ordinance is not subject to the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly. SECTION 4. Effective Date. This Urgency Ordinance was adopted by the necessary four-fifths vote of the members of the City Council pursuant to California Government Code Section 65858, and shall take effect immediately upon its adoption. SECTION 5. Publishing.
