1 RESOLUTION NO. R-130-07 2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF 3 COLTON, CALIFORNIA, ACCEPTING WITHDRAWAL OF THE DEVELOPMENT APPLICATION SUBMITTED BY GLOBAL 4 PREMIER DEVELOPMENT (FILE INDEX # DAP -000-668) FOR THE 5 FAIRWAY FAMILY APARTMENTS AFFORDABLE HOUSING PROJECT 6 7 WHEREAS, on August 21, 2007, the City Council conducted a continued public g hearing at the request of Global Premier Development ("Global Premier") to appeal the Planning 9 Commission's decision to impose certain conditions of approval on the affordable housing project 10 known as the "Fairway Apartments," submitted by Global Premier (the "Fairway Project"); and 11 WHEREAS, prior to the continued public hearing on August 21, 2007, Global 12 Premier had submitted a revised site plan to the City of Colton Community Development 13 Department to address the Planning Commission's concerns about the Fairway Project, as well as 14 concerns expressed by surrounding property owners; and 15 WHEREAS, after discussions with City staff and the City Attorney immediately prior 16 to the continued public hearing on August 21, 2007, Global Premier agreed to withdraw its original 17 development application, File Index # DAP -000-668, and process the revised site plan as a new 18 development application for the Fairway Project; and 19 WHEREAS, at the continued public hearing on August 21, 2007; the City Council 20 agreed to accept without prejudice Global Premier's withdrawal ofFile Index # DAP -000-668 and to 21 require that the new development application for the Fairway Project must be approved by both the 22 Planning Commission and the City Council. 23 BE IT NOW THEREFORE RESOLVED AS FOLLOWS: 24 SECTION 1: Incorporation of Recitals. The City Council hereby finds and 25 determines that the Recitals of this Resolution are true and correct and are hereby incorporated into 26 this Resolution as though fully set forth herein. 27 SECTION 2: Acceptance of Withdrawal of Application. The City Council accepts 28 without prejudice the withdrawal of the development application File Index # DAP -000-668 by Global Premier Development for the Fairway Project.
