Findings. The findings recited in the preceding paragraphs are true and correct. <br />2. Assessment District. The territory proposed to be annexed to the Assessment District as <br />described in the Report shall be included in Zone 3 of the Colton Landscape and Lighting <br />Maintenance Assessment District No. 1. The property which is proposed to be annexed to <br />the Assessment District is all the property which is identified as Tract No. 16912. The <br />boundaries of the property proposed to be annexed to the Assessment District are further <br />described and shown in the Report. The territory proposed to be annexed to the Assessment <br />District is generally located along Rosedale Avenue, between La Loma Avenue and Shirley <br />Court, in the City of Colton, County of San Bernardino. <br />3. Improvements. The Improvements which shall be provided for the property proposed to <br />be annexed to the Assessment District by and through the assessments levied annually <br />thereon shall include the following: <br />(a) the installation or construction of public lighting, facilities, including, but not limited to, <br />ornamental lighting; <br />(b) the installation or planting of landscaping, including, but not limited to, turf, ground <br />cover, shrubs, trees and entry monuments; <br />(c) the installation or construction of any facilities which are appurtenant to any <br />improvements listed in (a) and (b) or which are necessary or convenient for the maintenance <br />or servicing thereof including, but not limited to, irrigation systems, drainage systems, and <br />electrical facilities; and <br />(d) the maintenance and servicing of any of the foregoing. <br />4. Annexation. The territory described in Section 2 hereof is hereby annexed to the Colton <br />Landscape and Lighting Maintenance Assessment District No. 1. The diagram of the <br />Assessment District, as modified to include the territory hereby proposed to be annexed to <br />the Assessment District and as contained in the Report, is confirmed. <br />5. Levy of Assessments. The assessments proposed to be levied on the lots and parcels <br />that are hereby annexed to the Assessment District in the amounts set forth in the Report <br />and in the assessment ballot mailed to and returned by the owners of the property which is <br />hereby annexed to the Assessment District shall be and are confirmed and levied for fiscal <br />year 2007-08. <br />6. Duration of Assessments. The assessments which are to be levied on lots and parcels <br />that are hereby annexed to the Assessment District shall be levied as long as the <br />assessments are necessary to finance the cost of the operation, maintenance and servicing <br />of the improvements described in Section 3 hereof within and for the Assessment District. <br />The assessment amounts contained in the Report shall be subject to an annual adjustment or <br />increase in an amount up to three percent (3%) provided the amount of the assessment to be <br />levied on any parcel in any fiscal year shall not in any event exceed the actual total cost of <br />the proportional special benefit conferred on that parcel. <br />
