Code, §§ 21000 et seq.), the State CEQA Guidelines (14 CCR §§ 15000 <br />et seq.) and the City's Local CEQA Guidelines, the City of Colton is the lead agency <br />for the Project, as the public agency with the principal responsibility for approving <br />the Proj ect; and <br />WHEREAS, The City of Colton prepared and circulated a Notice of <br />Preparation (NOP) of a PEIR for the proj ect on October 9, 2007. The NOP review <br />period began on October 9, 2007 and ended on November 8. 2007. The NOP was <br />distributed to responsible and interested agencies and organizations and the State <br />Clearinghouse. A Public Notice of the Scoping Meeting was published in the a <br />newspaper of general circulation on October 9, 2007; and <br />WHEREAS, In response to the NOP, seven letters commenting on the <br />proposed project were received. Comments received were general in nature and <br />applicable to future SBVEZ-related and facilitated site specific projects; and <br />WHEREAS, A Scoping Meeting was held on October 29, 2007 at the Hutton <br />Center in Colton and no members of the public attended the scoping meeting; and <br />WHEREAS, Pursuant to Public Resources Code section 21092.5, the City <br />provided a Notice of Public Hearing and/or Intent to Certify an Environmental <br />Impact Report to all organizations and individuals who had previously requested <br />such notice, and published the Notice of Public Hearing on November 12, 2007 in a <br />newspaper of general circulation in the project area; and <br />WHEREAS, all potential significant adverse environmental impacts of the <br />Project were sufficiently analyzed in the Program EIR; and <br />WHEREAS, as contained herein, the City has endeavored in good faith to set <br />forth the basis for its decision on the Project; and <br />WHEREAS, all the requirements of CEQA, the State CEQA Guidelines, and <br />the City's Local Guidelines have been satisfied by the City in the Program EIR, <br />which is sufficiently detailed so that all of the potentially significant environmental <br />effects of the Project have been adequately evaluated; and <br />WHEREAS, the Program EIR prepared in connection with the Project <br />sufficiently analyzes both the feasible mitigation measures necessary to avoid or <br />substantially lessen the Project's potential environmental impacts and a range of <br />feasible alternatives capable of eliminating or reducing these effects in accordance <br />with CEQA, the State CEQA Guidelines, and the City's Local Guidelines; and <br />WHEREAS, all of the findings and conclusions made by the City pursuant to <br />this Resolution are based upon all oral and written evidence presented to it as a <br />whole and are not based solely on the information provided in this Resolution; and <br />2 <br />
