1 <br />2 <br />3 <br />4 <br />5 <br />6 <br />7 <br />8 <br />9 <br />10 <br />11 <br />12 <br />13 <br />14 <br />15 <br />16 <br />17 <br />18 <br />19 <br />20 <br />21 <br />22 <br />23 <br />24 <br />25i <br />26 <br />27' <br />28 <br />charged to residents; and <br />WHEREAS, based on the information contained in this Resolution and all other <br />information presented to the City Council on this matter, the City Council desires to establish <br />new and updated fees under the police power granted to cities by Article XI, Section 7 of the <br />California Constitution and pursuant to the provisions of Government Code section 66016. <br />BE IT NOW THEREFORE RESOLVED AS FOLLOWS: <br />1. Notice of the public hearing at which this Resolution was considered was <br />properly given pursuant to the provisions of Government Code section 66016, in which: (1) the <br />City published notice of the public hearing twice at least 10 days before the date of the hearing; <br />(2) the City sent notice of the meeting at least 14 days in advance to any interested person who <br />had filed a written request; and (3) the City made available to the public at least 10 days before <br />the meeting the data indicating the amount of the estimated costs required to provide the <br />services for which the proposed fees will be levied and the revenue sources anticipated to <br />provide the services, including General Fund revenues. <br />2. All oral and written presentations made to and heard by the City Council <br />I during the public hearing for this Resolution were properly considered. <br />3. The cost estimates, including the data upon which the cost estimates are <br />based, which was produced by City staff and considered by the City Council in establishing fees <br />pursuant to this Resolution, are reasonable cost estimates for the provision and maintenance of <br />the City services and facilities to which the fees pertain and were made available to the public <br />pursuant to Government Code section 66016. <br />4. There is a reasonable relationship between the fees to be collected for <br />the provision of various City services and facilities and the City's costs in providing and <br />maintaining those services and facilities, as identified in the data made available to the public. <br />5. The fees and fee increases set forth in Exhibit 'A" which is attached <br />hereto and incorporated herein by reference, do not exceed the actual or estimated costs to the <br />City of providing and maintaining the services and facilities to which the fees relate. <br />6. The fees and fee increases are necessary to enable the City to provide <br />the facilities and services to which they relate. <br />
