1 <br />2 <br />3 <br />4 <br />5 <br />6 <br />7 <br />8 <br />9 <br />10! <br />11 <br />12 <br />13 <br />14 <br />15 <br />16 <br />17 <br />18 <br />19 <br />20 <br />21 <br />23 <br />24 <br />25 <br />26 <br />27 <br />28 <br />WHEREAS, no comments made in the public hearings conducted by the City <br />or any additional information submitted to the City have produced substantial new <br />information requiring recirculation or additional environmental review under State CEQA <br />Guidelines section 15088.5; and <br />WHEREAS, all other legal prerequisites to the adoption of this Resolution <br />have occurred; <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF COLTON AS FOLLOWS: <br />SECTION I. DENIAL OF APPEAL <br />Based on the entire record before the City Council and all written and oral <br />evidence presented, including, but not limited to, the Appeal, Initial Study, the Final EIR, the <br />staff report, the attachments to the staff report, written and oral testimony given at meetings <br />and hearings, and submission of testimony from the public, organizations and regulatory <br />agencies, the City Council hereby denies the Appeal and upholds the Planning Commission's <br />approval of the Project. <br />SECTION II. FINDINGS <br />At a regular session assembled on June 17, 2008 the City Council of the City <br />of Colton, exercising its independent judgment, determined that, based on all of the evidence <br />presented, including but not limited to the Initial Study, the Final EIR, the staff report, the <br />attachments to the staff report, written and oral testimony given at meetings and hearings, and <br />submission of testimony from the public, organizations and regulatory agencies, the following <br />environmental impacts associated with the Project are: (1) less than significant and do not <br />require mitigation; or (2) potentially significant and each of these impacts will be avoided or <br />reduced to a level of insignificance through the identified mitigation measures and/or <br />implementation of an environmentally superior alternative to the Project; or (3) significant <br />and cannot be fully mitigated to a level of less than significant but will be lessened to the <br />extent feasible by the identified mitigation measures. <br />SECTION III. RESOLUTION REGARDING ENVIRONMENTAL IMPACTS <br />NOT REQUIRIN MITIGATION <br />� <br />
