R-89-08 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COLTON <br />APPROVING THE UPDATED 2007/2008 and 2008/2009 SAN BERNARDINO <br />ASSOCIATION OF GOVERNMENTS (SANBAG) TRAFFIC MITIGATION FEES TO <br />FUND REGIONAL TRANSPORTATION IMPROVEMENTS <br />WHEREAS, the City Council of the City of Colton (the "City Council") <br />recognizes the need to finance adequate regional roadway infrastructure and related roadway <br />improvements and facilities made necessary by new development in the City of Colton ("City") <br />and its sphere of influence; and <br />WHEREAS, the City is a member of the San Bernardino Association of <br />Governments ("SANBAG"), a joint powers agency that has prepared preliminary plans to <br />increase the capacity of the regional roadway system to benefit member agencies, including the <br />City; and <br />WHEREAS, SANBAG has commissioned a preliminary study ("Nexus Study") to <br />assess the impact of anticipated future development on the roadway system in San Bernardino <br />County, analyzing the need for new and upgraded roadway facilities and infrastructure generated <br />by the impacts of new development and analyzing necessary development mitigation <br />requirements to pay for the improvements ("SANBAG Traffic Mitigation Requirements"); and <br />WHEREAS, on November 2, 2004, the voters of San Bernardino County <br />approved Measure "I" which extended the half -cent sales tax for thirty years to provide funding <br />for various transportation improvements throughout San Bernardino County, including the <br />acquisition, construction, operation, and maintenance of streets, roads, and highways; and <br />WHEREAS, pursuant to Government Code Section 66000 et seq., the City is <br />empowered to impose new and increase existing development fees and other exactions to provide <br />necessary public facilities, including traffic improvements, required to mitigate the impacts of <br />new development; and <br />WHEREAS, it is fair and equitable for new development to pay its fair share and <br />contribute to the financing, acquisition and establishment such facilities to enable the City to <br />provide necessary traffic improvements to new residents, businesses and their employees; and <br />WHEREAS, the SANBAG Nexus Study complies with California Government <br />Code, Section 66001 by establishing the basis for the imposition of the SANBAG Traffic <br />Mitigation Requirements. In particular, the SANBAG Nexus Study: <br />1. Identifies the purpose of the development mitigation requirements; <br />2. Identifies the use to which the revenue will be put; <br />3. Demonstrates a reasonable relationship between the revenue's use and the <br />types of projects upon which the mitigation requirements are imposed; <br />4. Demonstrates a reasonable relationship between the need for the public <br />facilities and the types of developments upon which the fees are imposed; <br />and <br />5. Demonstrates a reasonable relationship between the amount of the <br />-1- <br />
