The City Council hereby adopts the "Records Retention and Destruction <br />Policy" (Pages 1 through 11; Dated 3-17-09) with its attached sample "Request for <br />Destruction of Obsolete Records" form (1 Page; Dated 3-17-09) and "Records Retention <br />Schedule" (Pages 1 through 41; Dated 3-17-09) which are attached hereto as Exhibit "A" <br />and incorporated herein and made a part of this Resolution. <br />Section 3. The City Council further grants that the City Manager and/or City <br />Attorney shall have ongoing authority, without further approval by the City Council, to make <br />minor amendments to Exhibit "A" from time to time, in accordance with changes to State <br />and federal laws and regulations which may affect retention periods for City records. <br />Section 4. Pursuant to the authority provided in Government Code section <br />34090.7, the City Council hereby prescribes that the City Clerk may at any time authorize <br />the destruction of any duplicate records that are less than finro (2) years old if such duplicate <br />records are no longer required. The City Clerk shall follow the destruction procedure <br />provided in Exhibit "A" when destroying any such duplicate records, except that City Council <br />approval shall not be required for destruction of such duplicate records. <br />Section 5. The City Clerk shall certify to the passage and adoption of this <br />Resolution. <br />Section 6. This Resolution shall become effective immediately upon its adoption. <br />PASSED, APPROVED AND ADOPTED this 17th day of March, 2009. <br />ATTEST: <br />EILEEN C.
