1 <br />RESOLUTION NO R-39-10 <br />2 <br />3 A RESOLUTION OF THE CITY COUNCIL OF THE CITY <br />4 OF COLTON ADOPTING AN AMENDED MASTER FEE <br />SCHEDULE FOR PROGRAMS & SERVICES PROVIDED <br />5 BY THE COMMUNITY SERVICES DEPARTMENT OF <br />6 THE CITY OF COLTON <br />7 WHEREAS, under the police power granted by Article XI, Section 7 of the California <br />8 Constitution, cities may impose fees, charges and rates for certain municipal services; and <br />9 <br />WHEREAS, in addition to the authority granted by the State Constitution, Government <br />10 Code section 66016 provides that a city may establish or increase fees for certain public services <br />11 by resolution, and; <br />12 <br />WHEREAS, the City Council of the City of Colton has determined that in order to <br />13 continue providing effective service for the public welfare, the City must establish and increase <br />14 fees for certain municipal services which accurately reflect the City's true costs in providing such <br />15 services, and; <br />16 WHEREAS, many of the City's existing fees for community and park facilities and <br />17 services no longer reflect the City's true costs in providing and maintaining the services and <br />18 facilities to which the fees pertain, as a result of increased costs borne by the City, and; <br />19 WHEREAS, the City Council has determined that the fees proposed in this Resolution <br />20 are reasonable, fair and equitable in nature and are proportionately representative of the costs <br />21 incurred by the City for the described services, and; <br />22 WHEREAS, in addition, the City Council has determined that it is reasonable and fair <br />23 for the City to subsidize programs and facilities for residents and charge a non -subsidized fee to <br />24 non-residents because the subsidy is paid from municipal funds which residents contribute to <br />through local property taxes and sales taxes and because the purposes of the community and park <br />25 facilities and services are to promote the health and welfare of residents, and; <br />26 <br />27 WHEREAS, the City Council has determined that the proposed non -subsidized fees for <br />non-residents are justified because: (1) the fees do not discriminate on the basis of race, color, <br />28 religion or national origin; (2) the fees are not higher than the City's cost to provide and maintain <br />the services and facilities; and (3) the fees are not disproportionately higher than the fees charged <br />to residents, and; <br />
