R-37-18 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COLTON TO <br />AMEND THE GENERAL PLAN LAND USE ELEMENT, LAND USE PLAN, TO <br />ALLOW THE DEVELOPMENT OF THE ROQUET RANCH SPECIFIC PLAN <br />(FILE INDEX NO. DAP -001-228). <br />WHEREAS, the Land Use Plan of the Land Use Element of the General Plan identifies a <br />Land Use Designations, and Goals and Policies for the development of properties in the City of <br />Colton; and <br />WHEREAS, on April 10, 2018, the Planning Commission of the City of Colton ("Planning <br />Commission") conducted a duly noticed public hearing and recommended that the City Council <br />adopt a General Plan Amendment No. DAP -001-228 to amend the Land Use Element of the <br />General Plan, adding Roquet Ranch Specific Plan; and <br />WHEREAS, all other legal prerequisites to the adoption of this Ordinance have occurred. <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF COLTON DOES <br />ORDAIN AS FOLLOWS: <br />SECTION 1. The City Council hereby adopts the recitals and findings set forth above and <br />in the agenda report prepared in connection with this Ordinance. <br />SECTION 2. General Plan Consistency. Based on the entire record before the City <br />Council and all written and oral evidence presented, including the staff report and the findings made <br />in this Resolution, the City Council hereby finds and determines that the proposed Amendment to <br />the General Plan Land Use Element, Land Use Plan is consistent with the goals and policies of the <br />City of Colton General Plan and is reasonably related to the public welfare of the citizens of the <br />City and surrounding regions. <br />SECTION 3. Hold Harmless. The Applicant shall defend, indemnify, and hold harmless <br />the City of Colton and its officers, employees, and agents from and against any claim, action, or <br />proceeding against the City of Colton, its officers, employees, or agents to attacks, set aside, void, <br />or annul any approval or condition of approval of the City of Colton concerning this project, <br />including but not limited to any approval or condition of approval of the city council, planning <br />commission, or development services director. The City shall promptly notify the Applicant of any <br />claim, action, or proceeding concerning the project and the City shall cooperate fully in the defense <br />of the matter. The City reserves the right, at its own option, to choose its own attorney to represent <br />the City, its officers, employees, and agents in the defense of the matter. <br />SECTION 4. The Land Use Plan (Figure LU -6) of the Land Use Element of the General <br />Plan, are hereby amended as shown on Exhibit A, attached hereto. <br />SECTION 5. Pursuant to CEQA Guidelines an Environmental Impact Report (EIR) has <br />been prepared for this project, as described above, to assess potential environmental impacts. An <br />EIR is comprised of two parts, the Draft EIR and the Final EIR. A Draft EIR was made available <br />
