2 <br />3 <br />4 <br />5 <br />6 <br />7 <br />8 <br />9 <br />10 <br />11 <br />12 <br />13 <br />14 <br />15 <br />16 <br />17 <br />18 <br />19 <br />20 <br />21 <br />22 <br />23 <br />24 <br />25 <br />26 <br />27 <br />28 <br />ORDINANCE NO. 0-06-18 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br />COLTON AMENDING PORTIONS OF CHAPTER 18.58 OF <br />TITLE 15 OF THE COLTON MUNICIPAL CODE RELATING TO <br />ADMINISTRATION OF THE CITY'S ZONING CODE <br />WHEREAS, the City Council of the City of Colton desires to amend certain provisions <br />of the Colton Zoning Code in order to clarify the procedures relating to appeals of zoning and <br />land use decisions by the City; and <br />WHEREAS, the proposed amendments do not amend regulations identified in California <br />Government Code, Section 65853; and <br />WHEREAS, the proposed amendments are consistent with the City of Colton General <br />Plan as they are intended to facilitate and clarify the administration of the City's Zoning Code <br />and General Plan; and <br />WHEREAS, all prerequisites to the adoption of this ordinance have occurred. <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF COLTON, <br />CALIFORNIA, DOES HEREBY ORDAIN AS FOLLOWS: <br />SECTION 1. Incorporation of Recitals. <br />foregoing recitals presented herewith are true <br />adopted as findings of the City Council. <br />The City Council hereby finds that all of the <br />and correct and are hereby incorporated and <br />SECTION 2. Section 18.58.100 of Chapter 18.58 of the Colton Municipal Code is <br />hereby amended to read as follows: <br />"Section 18.58.100 — Appeal Procedure. <br />A. The Decision of the Commission on all land Use Applications Shall be final Following a <br />ten -Day Appeal period. The Commission Shall, within two working Days from the date of the <br />Commission's action of any land Use Application, notify the Applicant by forwarding a Copy of <br />the Resolution to the address shown upon the Application. <br />B. The action of the Planning Commission in denying an Application Shall be final and <br />conclusive unless, within ten calendar Days Following the Notice of the Commission's action to <br />the Applicant, an Appeal in writing is filed with the City Clerk by the Applicant,ep rsons <br />residing or owning_ property within six hundred sixty feet from the external boundaries of <br />the Property subimect to the Planning Commission's decision, or the City Council pursuant to <br />subsection H below. <br />C. Upon receipt of a Written Appeal, the City Clerk Shall advise the Secretary of the <br />Planning Commission who Shall transmit the Planning Commission's Complete Record of the <br />case. <br />
