Additionally, the City <br />did provide documentation regarding the efforts being made to implement the required <br />identification, monitoring, education and outreach, and notification of non-compliance of those <br />commercial businesses and multi -family complexes that meet the definition of MCR; and, <br />WHEREAS, The City is still waiting for the final letter notification from Mr. de Bie to <br />see if he accepted staffs conclusion and recommendation of the City making a good faith effort to <br />comply with the MCR law; and, <br />WHEREAS, The Cities future compliance with the MCR Law will be based on the City's <br />on-going implementation efforts. It was recommended that City's MCR efforts should continue <br />enhancements in the following areas: <br />• Monitoring- The City needs to continue to monitor all businesses and multi -family <br />complexes subject to the MCR law. Through the monitoring, the City needs to verify <br />whether participation in the City's MCR program is being maintained. For those <br />businesses and multi -family complexes that are not participating in the City's MCR <br />program assessment should be completed to determine why a location is not participating. <br />• Education and Outreach- The City should continue to assess how MCR education and <br />outreach effort can be enhanced, such as updating websites and brochures, to provide City <br />specific MCR program information. <br />• Notification of Non -Compliance- The City needs to continue to notify those businesses <br />and multi -family complexes that are not in compliance with MCR requirements. This <br />notification should provide businesses and multi -family complexes clear information <br />regarding the violation of the law and the steps necessary to come into compliance with <br />the City's MCR program. This effort should be developed to support increasing the <br />overall participation in the City's MCR program. <br />• Annual Reporting- The City's annual report, submitted through the Departments Electronic <br />Annual Report (EAR), is to be complete and accurate. The report needs to reflect the City's <br />progress achieved in implementing the MCR law, including, but not limited to: identification, <br />monitoring, education, outreach, and if applicable, enforcement efforts; and, <br />WHEREAS, The City's future MCR implementation efforts will have significant impacts <br />on the City achievement of the MCR law. To ensure that the City continues implementation, <br />and ultimately achieves full participation within the City's MCR program it was necessary to <br />amend chapter 6.16 of the City's municipal code to maintain compliance; and, <br />WHEREAS, The City currently has 64 multi -family and 77 commercial businesses still <br />refusing to meet the States MCR law. The amendment to chapter 6.16 will provide Code <br />Enforcement the legal means to site for noncompliance the remaining multifamily and <br />commercial businesses not compliant. <br />NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF COLTON DOES <br />HEREBY ORDAIN AS FOLLOWS: <br />23152.06000\30578143.3 - 2 - <br />
