2 <br />3 <br />4 <br />5 <br />6 <br />7 <br />8 <br />9 <br />10 <br />11 <br />12 <br />13 <br />14 <br />15 <br />16 <br />17 <br />18 <br />19 <br />20 <br />21 <br />22 <br />23 <br />24 <br />25 <br />26 <br />27 <br />28 <br />ORDINANCE NO. 0-04-18 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE <br />CITY OF COLTON AMENDING SECTION 6.32.170 <br />OF CHAPTER 6.32 OF TITLE 6 OF THE COLTON <br />MUNICIPAL CODE FOR THE PURPOSE OF <br />ADDING ADMINISTRATIVE FINES FOR <br />VIOLATING CHAPTER 6.32 <br />WHEREAS, Chapter 6.32 of the Colton Municipal Code regulates fireworks within the <br />City of Colton ("City") and Section 6.32.170 provides the penalties for violating said Chapter; <br />and <br />WHEREAS, in response to an increasing number of illegal fireworks and fireworks <br />related incidents over the past few years, City Council has urged the Fire Department to seek <br />further alternatives to gain compliance with regards to illegal fireworks; and <br />WHEREAS, this amendment will add administrative fines for violating section 6.32.010, <br />subsection B, which applies to those persons selling, using, discharging or possessing all <br />fireworks that are not "Safe and Sane" fireworks, in the amount of $1,500.00 for the first violation <br />and $3,000.00 for a second violation within 24 months. <br />NOW, THEREFORE, the City Council of the City of Colton, California, does ordain as <br />follows: <br />SECTION 1. Incorporation of Recitals. The City Council hereby finds that all of the <br />foregoing recitals presented herewith are true and correct and are hereby incorporated and adopted <br />as findings of the City Council. <br />SECTION 2. Amendment to Colton Municipal Code Section 6.32.170. Code Section <br />6.32.170 of Chapter 6.32 of Title 6 of the Colton Municipal Code is hereby amended to read as <br />stated below for the purpose of increasing the penalties for violating Chapter 6.32. Additions to <br />Code Section 6.32.170 are underlined. <br />"6.32.170 - Violation—Penalty. <br />A. Persons violating this chapter Shall be deemed guilty of a misdemeanor and upon <br />conviction thereof, Shall be punished by a fine not to exceed one thousand dollars, or by <br />imprisonment in the City or County Jail for a period not exceeding six months, or by both such <br />fine and imprisonment. Further, the license Shall be revoked. <br />B. In addition to any other remedy available at law, any Person in violation of section <br />6.32.010, subsection B, is subject to an administrative fine of one thousand five hundred dollars <br />for the first violation and three thousand dollars for a second violation in a twenty-four month <br />neriod subsequent to the first violation. <br />C. The provisions and procedures concerning administrative fines and penalties set <br />forth in Chapter 8.12 of the Colton Municipal Code shall apply to administrative fines issued for <br />violations of this chapter.
