Conditions have been placed on the Residential Group Care Facility <br />2 which will mitigate any potential impacts created by the use and ensure <br />that the use will not negatively affect the surrounding community. <br />3 <br />3. That the proposed Use complies with each of the applicable <br />4 provisions of this title; The use conforms with the requirements of <br />the Colton Zoning Code, as conditioned. The subject property is zoned <br />5 R-1 (Low Density Residential) which permits Residential Group Care <br />6 Facilities for 7 or more persons, subject to approval of a Conditional <br />Use Permit. <br />7 <br />8 SECTION 3. Based on the entire record before the City Council, all written and <br />oral evidence presented, and the findings set forth in Sections 1 and 2 made in this <br />9 Resolution, the City Council hereby upholds the Appeal and overturns the decision of <br />the Planning Commission denying the application (DAP-001-447) for a Conditional Use <br />10 Permit, and thereby approves DAP-001-447 <br />11 SECTION 4. The City Council further finds that the project is exempt from CEQA <br />as provided for Section 15061(b)(4) of the California Environmental Quality Act (CEQA) <br />12 for any project rejected or disapproved by a public agency. <br />13 SECTION 5. The City Clerk shall certify to the adoption of this Resolution. <br />14 SECTION 6.
