City Council Resolution No. R-71-18 <br />Page 2 of 8 <br />1 SECTION 1. The Recitals set forth above are true and correct and are incorporated <br />herein by reference. <br />2 <br />SECTION 2. Based on the entire record before the City Council and all written and <br />3 oral evidence presented, including the staff report, the City Council finds that the findings <br />4 required for the issuance of a conditional use permit can be made based on the following: <br />5 1. That the proposed Use is in accord with the General Plan, the <br />objectives of this title, and the purposes of the zone in which the <br />6 site is located; The proposed Group Care Facility is consistent with <br />the following General Plan goals and objectives: <br />7 <br />A. General Plan Policy LU -8.3. "Encourage the provision of a range of <br />8 housing types and sizes to accommodate the varied needs of all <br />9 socioeconomic segments of the community." Per Section <br />18.48.100(A) of the Colton Municipal Code, the proposed Residential <br />10 Group Care Facility is consistent an in keeping with this section: "the <br />City Council finds that Residential, Community or Group Care Facilities <br />11 provide a cost-effective, humane and non -institutional environment for <br />elderly persons, persons suffering from chronic illness, persons <br />12 suffering from mental or physical impairments, and persons recovering <br />13 from drug/or alcohol addiction. Thus it is reasonable to provide <br />accommodations for the needs of persons with disabilities seeking a <br />14 humane and non -institutional environment, while at the same time <br />ensuring necessary safeguards to protect the integrity of residential <br />15 neighborhoods". <br />16 2. That the proposed Use, together with the conditions applicable <br />17 thereto will not be detrimental to the public health, safety or <br />welfare, or materially injurious to properties or improvements in <br />18 the vicinity; The proposed Residential Group Care Facility within an <br />existing residential dwelling will not be detrimental to the public health, <br />19 safety or welfare or materially injurious to properties or improvements <br />in the vicinity for the following reasons: <br />20 <br />21 A. The existing state licensed facility is required to meet a minimum <br />amount of professionally trained staff persons per the number of clients <br />22 that are residing at the home, including at least one staff member is <br />required to be on-site and awake 24 hours per day unless no clients <br />23 are on the premises. <br />24 B. All residential group care facilities shall be subject to all zoning, <br />25 subdivision, housing and Building regulations and codes applicable to <br />that to that district, in addition to any Building or housing regulations <br />26 and codes expressly applicable to Group Care Facilities, particularly <br />Building and fire safety requirements. <br />27 <br />28 <br />-2- <br />
